As VietNamNet reported, on the afternoon of January 23, Hung Yen Provincial Police said that Van Giang District Police had issued a decision to prosecute the case and prosecute Bui Phuong Nam (born in 1997) to investigate the act of "Resisting a person on official duty".

Bui Phuong Nam is a Tiktoker with the Tiktok account “Nam Birthday” with many followers. At around 4:55 a.m. on January 22, the Traffic Police Task Force of Van Giang District Police was on patrol on To Quyen Street, Nghia Tru Commune when they discovered a car driven by Nam going in the wrong direction.

The task force signaled for Nam to stop, but he refused and continued driving. After being stopped, Nam introduced himself as a Tiktoker, owner of the account "Nam Birthday" with many followers. Nam did not cooperate with the authorities, but instead used his phone to livestream the task force's image on social media, along with inappropriate words.

This Tiktoker asked the task force to present documents and called on viewers to share and comment to put pressure. And despite being explained and persuaded, Nam still did not comply.

Nam's breath alcohol test result was 0.887 milligrams per liter of breath, exceeding the regulation. Nam also could not present his vehicle registration. The police drew up an administrative violation report, temporarily detained and sealed the vehicle. Nam admitted his violation.

Another Tiktoker, Ms. Dau Thi Tam (born in 1980, in Hoang Mai district, Hanoi) has just been prosecuted and temporarily detained by the Hanoi Police Security Investigation Agency to investigate the crime of "Abusing democratic freedoms to infringe upon the interests of the State, the rights and legitimate interests of organizations and individuals" (stipulated in Article 331 of the Penal Code).

Ms. Dau Thi Tam is accused of regularly using her Tiktok account and Facebook account "Dau Thanh Tam" to post video clips with distorted and fabricated content about medical examination and treatment at a number of hospitals in the city, slandering and insulting the reputation of authorities and leaders at all levels...

Recently, after Decree 168/2024/ND-CP was issued, Ms. Tam posted a number of video clips with fabricated information, causing public confusion, as well as calling on and inciting people to protest the Decree.

Speaking to VietNamNet reporter, lawyer Giang Hong Thanh (Giang Thanh Law Firm) said that Tiktoker Bui Phuong Nam's behavior showed contempt for the law. According to the lawyer, Nam's actions probably stemmed from his own "delusion of power", thinking that he was the center of the universe, that everyone had to respect and admire him, just because he was followed and praised by many people on social networks.

During the livestream, Nam continuously updated with pride that there were 30,000, 40,000 people watching live, and Nam thought that was enough for the subject to react negatively to the police officers, that the authorities were avoiding Nam because of the "huge" number of people watching the livestream.

Mr. Giang Hong Thanh said that Bui Phuong Nam’s case is not an exception. In fact, many Tiktokers and Facebookers with large followings are “high on power”, believing that they not only have influence on social networks but also command respect and admiration in real life.

Because of that illusion, many Tiktokers and Facebookers have offended the honor, dignity, and reputation of individuals, agencies, and organizations, and more seriously, infringed upon and damaged the legitimate rights and interests of individuals and legal entities.

Recently, authorities have taken strong actions to deal with deviant and illegal behaviors committed by social network users. This is extremely necessary to restore order in cyberspace.

"Hopefully, Bui Phuong Nam's incident will be a warning lesson for those who have been thinking about taking advantage of their "virtual" influence to commit deviant acts in life," said the lawyer.
