Perfecting legal policies on greenhouse gas emission reduction and ozone layer protection

Minister Do Duc Duy chaired a meeting to finalize the Draft Decree amending and supplementing a number of articles of Decree 06/2022/ND-CP dated January 7, 2022 of the Government regulating the reduction of greenhouse gas emissions and protection of the ozone layer.

Reporting at the meeting, Director of the Department of Climate Change Tang The Cuong informed that the implementation of the Law on Environmental Protection stipulates on greenhouse gas emission mitigation (Article 91), ozone layer protection (Article 92), organization and development of carbon market (Article 139). On January 7, 2022, the Government issued Decree No. 06/2022/ND-CP regulating greenhouse gas emission mitigation and ozone layer protection.

Given the actual situation of the need for carbon credit exchange and carbon market development, Decree No. 06/2022/ND-CP needs to be amended to focus on: strengthening greenhouse gas inventory, organizing the allocation of greenhouse gas emission quotas, carbon credit management, organizing the carbon market and some contents on ozone layer protection.

Mr. Tang The Cuong said that the process of drafting the Decree was in compliance with the provisions of the Law on Promulgation of Legal Documents. Accordingly, the Draft Decree amends 20/35 articles, adds 01 article, and abolishes 01 article of Decree No. 06/2022/ND-CP; amends 12 forms, adds 26 forms, and abolishes 01 form in the appendix of Decree No. 06/2022/ND-CP.

At the meeting, leaders of the units discussed and exchanged specific details on regulations on strengthening greenhouse gas inventory work; regulations on organizing the allocation of greenhouse gas emission quotas; regulations on organizing the carbon market, carbon credit management; and regulations on ozone layer protection management.

Delegates also discussed and developed content on administrative procedures (APs). The APs were amended and supplemented in the direction of simplification, increased decentralization, socialization and digitalization, and reuse of data in the implementation of administrative procedures. Accordingly, the Draft Decree added 09 new APs; amended in the direction of transparency and simplification of 02 APs out of a total of 04 APs stipulated in Decree No. 06/2022/ND-CP; socialized organizations that are eligible to participate in the implementation of 02 APs and had solutions to implement online public services for APs on the National Public Service Portal and the National Registration System...

Based on the constructive comments at the meeting, Minister Do Duc Duy informed that at the closing session of the 10th Central Conference of the 13th tenure, General Secretary and President To Lam shared the strategic directions and solutions in the coming time, which must "Resolutely develop socio-economic development and protect the environment as the center..." Therefore, we will focus on developing new productive forces, including digital transformation, green transformation... all of which will aim to reduce greenhouse gas emissions and net emissions to "0".

Directing at the meeting, Minister Do Duc Duy said that contents such as reducing greenhouse gas emissions and protecting the ozone layer, regulating the organization of carbon markets, carbon credit management, etc. are all issues of concern to the whole world. These are also new and difficult issues in the contents of market development, carbon credit management, etc. Therefore, amending legal documents to suit reality must be certain and comprehensive. Issues that are "ripe enough", clear need to be strictly regulated, issues that are still being researched and supplemented, need to be piloted step by step to improve in theory, practice and law.

Therefore, the Minister suggested that the drafting agency should have a comprehensive assessment and make appropriate adjustments so that when implementing legal policies, they can easily be put into practice. Point out the contents that the world is implementing to update and perfect according to the world's criteria.

The drafting agency needs to complete the Decree in the direction of clearly defining the responsibilities of agencies, organizations, localities, enterprises and people in the process of participating in programs on greenhouse gas emission reduction and ozone layer protection; in which clearly stipulate the tasks, responsibilities, powers and interests of the parties in managing, inventorying, measuring and quantifying emission objects, as well as setting out targets, emission reduction programs, emission reduction technologies, etc. The Minister emphasized that policy making must promote decentralization and delegation of authority along with resource allocation, strengthen inspection and supervision of implementation and strongly reform administrative procedures.
