Hanoi terminates implementation of 2 projects of HUD Corporation in Me Linh

The Hanoi People's Committee has just issued a decision to terminate and stop implementing Decision 2879 dated September 15, 2005 of the Vinh Phuc Provincial People's Committee and the instructions of the Vinh Phuc Provincial People's Committee and the City People's Committee related to the research and implementation of the Me Linh - Dai Thinh New Urban Area Project and the Thanh Lam - Dai Thinh 1 New Urban Area Project in Me Linh District.

The reason for the revocation is clearly stated: Because the two previous projects have just had documents approving the location for planning and construction of urban areas by the People's Committee of Vinh Phuc province (including the name of the investor), but have not yet carried out the appraisal procedures and investment permission according to the regulations at the time of approval of the above location according to Decree No. 02/2006/ND-CP dated January 5, 2006 of the Government and the guiding document of the Ministry of Construction in Circular No. 04/2006/TT-BXD dated August 18, 2006.

In addition, these two projects are currently not subject to transition according to the provisions of the Investment Law 2020 and Decree No. 31/2021 dated March 26, 2021 of the Government.

The Hanoi People's Committee assigns the city's departments and branches and the Me Linh District People's Committee to organize the implementation of state management of the land in the above two projects according to their functions, tasks and regulations of current law.

The People's Committee of Me Linh district is assigned to study and propose a plan for managing and exploiting the land (after terminating and stopping the implementation of the instructions of the People's Committee of Vinh Phuc province and the People's Committee of Hanoi city related to the research and implementation of the above two projects), in order to promote the effectiveness of land use, ensuring compliance with current legal regulations.

These two terminated and suspended projects have a total area of 189.7 hectares, of which the Me Linh - Dai Thinh New Urban Area Project has an area of 136.6 hectares and the Thanh Lam - Dai Thinh 1 New Urban Area Project has an area of 53.1 hectares.

Previously, the Hanoi People's Committee held a meeting to consider terminating or stopping the implementation of a number of investment projects that were slow to deploy and violated the Investment Law and Land Law in the city.

Accordingly, the Hanoi People's Committee basically agrees with the proposed report of the Department of Planning and Investment (in Official Dispatch No. 3379 dated July 26, 2022) to terminate and stop the implementation of a number of investment projects that are slow to deploy, violate the Investment Law and the Land Law in the city, which were agreed upon by the city's Departments, branches, and People's Committees of districts and towns at the meeting.

Specifically, the Hanoi People's Committee agreed to terminate and stop implementing investment projects, including: Mixed-use building project with a part sold to officers and soldiers of the Vietnam Interpol Office in My Dinh 2 ward, Nam Tu Liem district; Dai Thinh ecological urban area project in the communes of Me Linh, Van Khe and Dai Thinh, Me Linh district; Viet A new urban area project in Thanh Lam commune, Me Linh district; BMC Thang Long urban area project in Dai Thinh commune, Me Linh district; Phuong Vien high-end housing project in the communes of Thach Da, Dai Thinh, Van Khe, Tam Dong, Me Linh district; Quang Minh Bac urban area project and Quang Minh Nam urban area project in Thuong Tin district.

For the two new urban area projects Me Linh - Dai Thinh and Thanh Lam - Dai Thinh 1 new urban area projects in the communes: Dai Thinh, Thanh Lam and Me Linh, Me Linh district; according to the report, they are not under the Department of Planning and Investment's chair, inspection and review according to Plan No. 235 dated October 21, 2021 of the City People's Committee.

The City People's Committee assigned the Department of Planning and Investment to study, evaluate and consider reporting to the City Party Committee, and at the same time work with the Housing and Urban Development Investment Corporation - Ministry of Construction to have a document agreeing to stop implementing the investment project according to regulations.

For the project of garden houses and apartments serving low-income people in Quang Minh town, Me Linh district (included in the list of statistics on handover of documents and procedures in Me Linh district by the construction sector of Vinh Phuc province to the city, however, up to now there is no information or documents related to the legal entity of the investor, land records, planning, investment project; the investor has not contacted to resolve procedures related to the project): Assign the Department of Planning and Investment to post contact information, work with the investor according to regulations, as a basis for reporting to the City People's Committee, reporting to the City Party Committee for consideration and direction on the termination and suspension of implementation of this investment project .
