The proposal to add regulations on the age limit for driving practice vehicles and testing vehicles is the content of the draft Decree related to the management of automobile transportation activities, car driver training services and driving testing services that the Ministry of Transport is seeking opinions on.

The Ministry of Transport is seeking comments on the draft Decree amending and supplementing a number of articles of the Decrees related to the management of automobile transport activities, automobile driver training services and driver testing services (including Decree 65/2016/ND-CP, Decree 10/2020/ND-CP, Decree 119/2021/ND-CP) (referred to as the draft Decree).

1. Proposal to add regulations on age limit for driving practice vehicles

Accordingly, the draft Decree proposes to amend Clause 2, Article 6 of Decree 65/2016/ND-CP (amended in Decree 138/2018/ND-CP and Decree 70/2022/ND-CP) on conditions for driving practice vehicles as follows:

- Have driving practice vehicles of all categories under the legal use of the driving training facility; have been granted a driving practice vehicle license by a competent authority; in case the training facility has a driving test service, based on the time of using the testing vehicle for testing purposes, it is allowed to use the testing vehicle to both conduct driving tests and train drivers, but the number of testing vehicles used to calculate the training volume must not exceed 50% of the number of testing vehicles used to teach driving practice;

- Trucks used for teaching driving classes B1, B2 must have a load capacity of 1,000 kg or more, with a quantity not exceeding 30% of the total number of training vehicles of the same class at the training facility. Training vehicles of classes B1, B2 and FB have a life span of no more than 20 years (from the year of manufacture); training vehicles of classes C, FC, D, E, FD and FE have a life span according to the provisions of Decree 95/2009/ND-CP regulating the life span of cargo and passenger vehicles.

Currently, Clause 2, Article 6 of Decree 65/2016/ND-CP (amended in Decree 138/2018/ND-CP and Decree 70/2022/ND-CP) stipulates the conditions for driving practice vehicles as follows:

- Have driving practice vehicles of all categories under the legal use of the driving training facility; have been granted a driving practice vehicle license by a competent authority; in case the training facility has a driving test service, based on the time of using the testing vehicle for testing purposes, it is allowed to use the testing vehicle to both conduct driving tests and train drivers, but the number of testing vehicles used to calculate the training volume must not exceed 50% of the number of testing vehicles used for driving instruction;".

- Trucks used to teach driving of classes B1 and B2 must have a load capacity of 1,000 kg or more, with the number not exceeding 30% of the total number of driving practice vehicles of the same class at the training facility.

2. Proposal to add regulations on age limit for testing vehicles

Accordingly, the draft Decree proposes to amend Point c, Clause 1, Article 18 of Decree 65/2016/ND-CP (amended in Decree 138/2018/ND-CP) on conditions for motor vehicles used for testing as follows:

Number of motor vehicles used for testing: Testing drivers in the form of A1, B1, B2 and C requires at least 02 vehicles each, other categories require at least 01 vehicle each and cannot be used for other business purposes; testing drivers on the road requires at least 01 vehicle each. Vehicles for testing drivers are under the legal use of organizations and individuals that have driving testing centers.

Vehicles for testing driving licenses of classes B1, B2 and FB have an age limit of no more than 20 years (calculated from the year of manufacture); vehicles for testing driving licenses of classes C, FC, D, E, FD and FE have an age limit according to the provisions of Decree 95/2009/ND-CP regulating the age limit of use for cargo and passenger vehicles.

Meanwhile, Point c, Clause 1, Article 18 of Decree 65/2016/ND-CP (amended in Decree 138/2018/ND-CP) stipulates the conditions for motor vehicles used for testing as follows:
