According to Prof. Dr. Tran Ngoc Duong - Chairman of the Advisory Council for Democracy and Law of the Central Committee of the Vietnam Fatherland Front, supervision and social criticism are means for the Vietnam Fatherland Front at all levels to exercise the rights and responsibilities of controlling state power, which have the effect of preventing and combating the degeneration of state power. With a team of people who are knowledgeable about the theory of state and law, experts with practical experience in law, the Advisory Council for Democracy and Law increasingly affirms its important role, contributing to the Vietnam Fatherland Front in promoting its role in participating in building the Party and State, protecting the legitimate rights and interests of the people.
Over the years, the Advisory Council for Democracy and Law has organized research, criticism, and comments on many draft laws, decrees, circulars, and projects with good quality and effectiveness, which have been recognized and highly appreciated by the drafting agencies. During the 9th term alone, the Advisory Council for Democracy and Law has advised the Standing Committee and the Presidium of the Vietnam Central Committee to participate in developing and perfecting the Party's policies and the State's laws. It has organized meetings to criticize society on draft laws such as the Land Law, Construction Law, Consumer Protection Law, Housing Law, etc.
"Through activities of providing comments and social criticism on draft legal documents and social supervision as well as through local surveys, the Advisory Council for Democracy and Law has actively participated in the tasks of the Vietnam Fatherland Front" - Prof. Dr. Tran Ngoc Duong affirmed.
Proposing some solutions to improve the quality of social supervision and criticism of the Vietnam Fatherland Front, Prof. Dr. Tran Ngoc Duong said that social supervision and criticism of the Vietnam Fatherland Front at all levels is still a new issue in general. Therefore, in terms of awareness as well as in practical organization, social supervision and criticism activities have not been considered a method of representing the people to control state power to ensure that state power operates within the framework of the Constitution and the law, contributing to preventing the degeneration of state power. It is necessary to continue to raise awareness more fully and deeply about social supervision and criticism activities and they must become the brand of the Vietnam Fatherland Front at all levels.
According to Prof. Dr. Tran Ngoc Duong, controlling power plays a particularly important role in Party building and building a clean and strong government. The 2013 Constitution has laid the constitutional foundation for building and perfecting the mechanism for people to control state power. This is a mechanism by which individuals, citizens and non-state organizations control state power. This mechanism has been gradually built and perfected since the 2013 Constitution came into effect. However, the Law on the Vietnam Fatherland Front only stipulates general principles and procedures, lacking specific provisions, including sanctions for agencies and organizations that are subject to social supervision and criticism by the Vietnam Fatherland Front. Therefore, it is necessary to continue perfecting the institution on social supervision and criticism to create conditions for the Front to better participate in Party and State building.
