Former Chairman of SCB Board of Directors said he couldn't sleep, his wife and mother cried their eyes out

On the afternoon of March 21, the trial of defendant Truong My Lan (68 years old, Chairwoman of Van Thinh Phat Group) and 85 other defendants continued with the defense.

Defending himself, defendant Bui Anh Dung (62 years old, former Chairman of the Board of Directors of SCB) said that the sentence proposed by the Ho Chi Minh City People's Procuracy to sentence him to life in prison was too harsh.

" After hearing the Ho Chi Minh City People's Procuracy's proposal for a life sentence, the defendant could not sleep. His wife and mother cried their eyes out," Bui Anh Dung explained.

Defendant Bui Anh Dung was accused of embezzlement and violating regulations on banking activities and other activities related to banking activities. The People's Procuracy proposed a life sentence for this defendant.

According to the indictment, Bui Anh Dung actively assisted Truong My Lan in creating fake loan documents and withdrawing money from SCB, causing extremely large losses. In particular, from 2013 to 2020, Bui Anh Dung signed legal documents for 404 loans, causing losses to SCB of more than VND 187,600 billion.

From 2020 to 2022, Dung signed legal documents for 207 loans, actively helping Truong My Lan embezzle VND 104,000 billion and causing losses of VND 26,330 billion.

Defending defendant Bui Anh Dung, the lawyer said that the above penalty was not fair to the nature, role, and level of the defendant's crime.

The lawyer asked the panel of judges to reconsider his client's role as an accomplice in the case and said that defendant Dung did not actively assist defendant Truong My Lan.

According to the lawyer, most of the loans of defendant Truong My Lan at SCB were disbursed before the consultation and approval work was carried out, or if approved by the Board of Directors before disbursement, defendant Dung was only allowed to have preliminary contact as submitted by subordinates after legalization.

From there, the lawyer argued that his client, with his position and circumstances, even though the loan was from Truong My Lan, defendant Bui Anh Dung was forced to passively sign and could not do otherwise.

Dung only worked for a salary. Dung was recommended by defendant Dinh Van Thanh to Truong My Lan because he was a gentle person and did not cause trouble. The damage Dung caused was very low compared to the defendants who played key roles in SCB, so the lawyer asked the panel of judges to consider a lighter sentence for the defendant.

Tuong Viet CEO: Request to acknowledge that 100% of the damage has been repaired

Defending himself, defendant Duong Tan Truoc (41 years old, General Director of Tuong Viet Trading and Production Company Limited) said that he had remedied the remaining consequences related to the loans of 6,000 billion VND.

"The defendant has recovered more than 800 billion, but in fact the assets that have been frozen are more than 2,000 billion VND, so I request the court to recognize that 100% of the damage has been recovered," the defendant said.

Defendant Duong Tan Truoc was accused of having agreed with Truong My Lan to use the legal entities of Tuong Viet Company Group, coordinate with SCB officials, create fake loan documents, and withdraw money from SCB for use. The defendant assisted Lan in appropriating more than VND4,750 billion, causing a loss of VND605 billion.

Defendant Truoc was given 1,498 billion VND by Truong My Lan, which she used for personal purposes. After the case was prosecuted, the defendant remedied the consequences, paying SCB more than 813 billion VND for loans from Tuong Viet Company and Viet Duc Company.

In addition, Truoc also received more than 2,200 billion VND from Lan. The defendant requests to return all the money received from Lan to remedy the consequences.

Defending the defendant Truoc, the lawyer said that because he trusted the commitment and reputation of Ms. Truong My Lan and truly wanted to receive the transfer of the Thanh Yen project for development, Mr. Truoc agreed to prepare a loan application at SCB.

Tuong Viet Company has a reputation with banks. Although it is a business relationship with Truong My Lan, it is essentially a superior-subordinate relationship, with no intention of appropriating SCB.

According to the lawyer, Mr. Truoc did not benefit from the loan because Ms. Lan did not fulfill her original commitment and did not transfer the project to Mr. Truoc and the Tuong Viet Company group.

Therefore, the lawyer hopes that the panel of judges will consider and apply Clause 2, Article 54, to give the defendant the lightest possible sentence.

According to the indictment, after the case was initiated, on October 17, 2022, Duong Tan Truoc and Tuong Viet Company paid part of the principal and interest, and to date the outstanding debt of the two loans is more than 900 billion VND.

Duong Tan Truoc also received more than 2,697 billion VND from Truong My Lan. Duong Tan Truoc has returned more than 492 billion VND to the owner of Van Thinh Phat, and now has more than 2,204 billion VND. The defendant voluntarily returns all the money to Truong My Lan to remedy the consequences of the case and wishes to use all of his assets with his family to remedy the consequences of the case.
