Circular 29 on extra teaching and learning, which will be applied from February 14, is becoming a hot topic on all forums. Many people believe that teachers have found ways to "circumvent the law".
Circular 29 regulates extra teaching and learning, is it a "law loophole"?
As a former teacher and currently very interested in education, Mr. Thai Hao said: "On February 14, Circular 29 on prohibiting schools from giving extra classes and prohibiting teachers from giving extra classes to their regular students will take effect. This is a regulation that is making parents and people across the country "excited", because of the hope that it will bring positive effects to many aspects of society and education in our country.
However, according to my observations, research and information collection, currently in many localities - schools, there have been many activities, many tricks to "circumvent the law" to deal with this regulation.
Specifically, there are cases where schools legally rent other facilities (with the name of the company director or center director), then sign a contract with the school, hiring teachers from that school to teach. The name of the person teaching is not the main teacher, but in reality, the main teacher still teaches. Another teacher comes in to collect the money.
In the case of teachers taking students home, they borrow/hire someone else to be the business owner. Then hire a teaching assistant, and that teacher still teaches. When there is an inspection, that teacher becomes a teaching assistant. Elementary school teachers are busy studying for life skills certificates, then come back to teach life skills. There are more sophisticated cases, for example, based on the way tasks are assigned to teachers to attract or "give the green light" for students to come home/center to study extra.
Mr. Bui Ngoc Phuc, author of the books "Overcoming Exams with Children" and "Advice on 10th Grade Entrance Exams", said: "On social networks, many teachers tell each other how to "circumvent the law". If the regulation prohibits extra classes in primary schools except for skill classes, of course, to circumvent the law, teachers will study and have certificates in a few skill subjects and organize clubs. Instead of studying Vietnamese, students will join the Creative Language Club. For Math, it will be the Thinking Discovery Club. When there is no consensus from the family and strict inspection from the school, primary school students still continue to take extra classes right after their regular classes.
For secondary and high school teachers, they can organize classes but under the name of someone else, maybe a retired teacher, and in theory they are not wrong. However, for teachers with a large number of students, they will strictly comply when registering their business and paying taxes in full."
Mr. Phuc commented: "The regulations on extra teaching that have just come into effect have expanded and covered both extra teaching inside and outside of school, instead of a prohibition directive as before. Extra teaching in school is similar to the old tutoring program for weak students; good students need to review for the national team exam.
It is right to tighten regulations that require teachers who teach outside of school to register their business, because for many years now, there have been teachers who have earned billions from teaching extra classes but have not paid a single cent in income tax. That is unfair.
Extra tutoring is not bad, it comes from the real needs of parents but has long been distorted when teachers who teach in class have oppressed students when they do not take extra lessons in their class. This time, the regulation has added a ban on teachers teaching students in class, also to improve the educational environment.
I myself have a child who takes extra classes for the purpose of improving knowledge. I support the regulations on extra teaching and learning issued by the Ministry of Education and Training and will take effect from February 14. Especially, it is strictly prohibited to teach extra classes from primary school level, only then will children have a proper childhood. The regulations have been issued, the important thing is the response of parents, only then will the problems of extra teaching and learning be eliminated."
A teacher in Hai Duong also confirmed that there are many other forms of "circumvention of the law". Currently, teachers are waiting for instructions from the Department of Education and Training to implement appropriate solutions.
Manage but not ban
On December 30, 2024, the Ministry of Education and Training issued Circular 29/2024/TT-BGDDT regulating extra teaching and learning. The Circular takes effect from February 14, with many new points compared to the current regulations in Circular 17/2012/TT-BGDDT.
Extra teaching and learning are legitimate needs of both teachers and students. However, in reality, there are situations where students, even though they do not want to, still have to take extra classes organized by their own teachers and schools. Some students have to take extra classes just to avoid being out of place with their friends, not to feel guilty towards their teachers, or even to avoid being unfamiliar with their tests. Taking too much extra classes makes students have no time to rest, study by themselves, absorb, and apply knowledge. The fact that some teachers "force" students they teach to take extra classes also affects the image of teachers in the eyes of students, parents, and society.
Based on the above reality and the requirement of "Abandoning the mindset of not being able to manage, then banning ", the Ministry of Education and Training built Circular 29 in the spirit of not banning extra teaching but finding the cause to have a suitable and effective management plan.
Circular 29 is consistent with modern educational trends and the 2018 General Education Program. The 2018 General Education Program has specified the number of periods/subject, setting out requirements for each subject that are suitable for students. The Ministry of Education and Training also gives schools the autonomy to develop plans to ensure effectiveness, teachers focus on innovating teaching methods to achieve the goal of the 2018 General Education Program, which is to develop students' capacity.
Thus, in principle, schools and teachers who implement the prescribed study hours can ensure that students acquire knowledge and meet the requirements of the educational program. In addition to the study hours according to the program, schools need to organize many fun activities, sports training, drawing, music, etc. for students to participate enthusiastically.
Mr. Nguyen Xuan Thanh, Director of the Department of Secondary Education, emphasized that the new point in this Circular is that the Ministry of Education and Training stipulates 3 subjects of extra teaching and learning in schools but is not allowed to collect money from students, including: Students with unsatisfactory subject learning results; Students selected by the school to nurture excellent students; Students reviewing for graduation exams and entrance exams.
Thus, the school and teachers have implemented the prescribed study hours to ensure that students have the knowledge and meet the requirements of the program. If students have not met the requirements, the school must be responsible for teaching extra lessons, also known as knowledge remediation. The same is true for students selected to train excellent students and students preparing for final exams, which are included in the school's plan.
In addition, teachers need to guide students on self-study and self-discovery methods to absorb the content learned in class, avoiding the practice of forcing knowledge into extra classes, which is ineffective. The Ministry of Education and Training limits 3 subjects of extra teaching and learning in schools to target schools that do not have extra teaching and learning.
