Under the direction of the Ministry of Industry and Trade, the local Department of Industry and Trade is soliciting comments on the Draft Decree amending and supplementing Decree No. 45/2012/ND-CP of the Government on Industrial Promotion (Draft Decree). Regarding this task, Mr. Ngo Quang Trung - Director of the local Department of Industry and Trade - said that at the end of 2023, the Ministry of Industry and Trade organized a review of 10 years of implementing Decree No. 45/2012/ND-CP of the Government on industrial promotion. At the conference, representatives of localities all affirmed that this policy is truly a lever for the rural industry to "change its skin".
However, after 10 years of implementation, compared to the reality of Decree No. 45, there are some points that are no longer suitable, requiring amendments and supplements to help the industrial promotion policy "shake off" the bottlenecks, promote feasibility, and join hands with the industry and trade sector to accelerate development in the new context. Therefore, the amendments and supplements will not go into "small details" but only focus on amending and supplementing major contents of a comprehensive nature.

The draft Decree amending and supplementing is designed to include 4 articles: Article 1 - amending and supplementing a number of articles of Decree No. 45; Article 2 - changing a number of words; Article 3 - entry into force; Article 4 - responsibility for implementation.
Regarding Article 1, there are 16 contents synthesized from proposals and recommendations of ministries, branches and localities, in which the most prominent is the subjects applying industrial promotion policies.
Regarding this content, there are many conflicting opinions, many localities have proposed to consider adjusting the applicable subjects in the direction of expanding the area, regardless of type 1, 2, 3 cities; expanding for large enterprises to participate to enjoy industrial promotion policies; not limiting rural areas; removing the word "rural" from the scope of regulation of the Draft Decree.
However, after research, the Ministry of Industry and Trade and the local Department of Industry and Trade hope and agree that the Draft Decree will try to closely follow the instructions and orientations of the Party Central Committee in Resolution No. 19 on agriculture, farmers, and rural areas and not separate the industrial promotion policy from the process of industrialization and modernization of agriculture and rural areas.
On the other hand, the Government has issued the Urban and Rural System Planning for the period 2021 - 2030, with a vision to 2050. In this planning, the urbanization rate by 2030 will be over 50% and by 2050 it will be over 70%. Thus, with that growth rate, if the applicable subjects are kept the same as Decree No. 45, there will be localities with fewer and fewer subjects applying the industrial promotion policy, or even no subjects applying it anymore.
On the contrary, there are also localities that propose to expand the area limit but keep the criteria for applicable subjects to ensure that investment in production development is encouraged mainly in rural areas. " This is a difficult content, after receiving opinions, the drafting committee will study and select appropriate subjects ," said Mr. Ngo Quang Trung.
The draft Decree also adds the subject of sustainable production and consumption establishments to further update the content related to cleaner production, in accordance with the National Action Program on Sustainable Production and Consumption for the period 2021 - 2030 that has been issued. At the same time, artisans are added to the subject of industrial promotion policies.
Another highlight of the Draft Decree is stronger decentralization and delegation of power, accordingly, the Ministry of Industry and Trade has the authority to approve the national industrial promotion program...
These are major and new contents in the Draft Decree, and are also the obstacles for localities in the process of implementing industrial promotion work at present.
“ Based on local comments, the Drafting Committee will absorb and complete the draft and continue to solicit comments from local authorities and relevant agencies before submitting it to the Government, ” said Mr. Ngo Quang Trung. At the same time, he emphasized that the Draft Decree is expected to be issued in early 2025, there is not much time left, the drafting unit will strive to speed up the implementation progress to ensure the implementation progress according to the assigned plan.
