Can I ask if the new regulations will integrate the health insurance card, driver's license, and birth certificate into the ID card? - Reader Thuy Hai
On November 27, 2023, the National Assembly officially passed the Law on Identification to replace the 2014 Law on Citizen Identification.
The Law on Identification officially takes effect from July 1, 2024. Accordingly, the Citizen Identification Card will also be called by a new name, the Identification Card.
1. From July 1, 2024, the ID card will be integrated with health insurance card, driver's license, birth certificate.
According to Article 22 of the 2023 Law on Identification, regulations on integrating information into identification cards and using and exploiting integrated information are as follows:
- Integrating information into the ID card is the process of adding information other than the identity information to the ID card's storage and is encrypted. Information is integrated at the request of citizens and must be authenticated through the national database and specialized database.
- Information integrated into the ID card includes information on health insurance cards, social insurance books, driver's licenses, birth certificates, marriage certificates or other documents decided by the Prime Minister, except for information on documents issued by the Ministry of National Defense.
- Using information integrated into the ID card has the same value as providing information or using documents containing that information in performing administrative procedures, public services, transactions and other activities.
- People request to integrate information into the ID card when needed or when issuing, changing, or reissuing the ID card.
- The exploitation of integrated information encoded in the identity card is regulated as follows:
+ Use specialized equipment to exploit information integrated in the encrypted storage part of the ID card;
+ Use information on the ID card through specialized equipment to retrieve and exploit integrated information through the National Population Database and the electronic identification and authentication system;
+ State agencies, political organizations, and socio-political organizations are allowed to exploit integrated information encoded in the identity card to perform assigned functions and tasks;
+ Organizations and individuals exploit the integrated information encoded in the citizen's identity card with the consent of that citizen.
Thus, citizens can integrate into their identity cards information including health insurance cards, social insurance books, driver's licenses, birth certificates, marriage certificates or other documents decided by the Prime Minister, except for information on documents issued by the Ministry of National Defense.
Accordingly, the use of information integrated into the identity card has the same value as providing information or using documents containing that information in performing administrative procedures, public services, transactions and other activities.
2. Use value of ID card
- The identity card has the value of proving the identity and other information that has been integrated into the identity card of the cardholder to carry out administrative procedures, public services, transactions and other activities in the territory of Vietnam.
- Identity cards are used instead of immigration documents in cases where the Socialist Republic of Vietnam and a foreign country sign an international treaty or agreement allowing citizens of the signatory countries to use identity cards instead of immigration documents in each other's territories.
- The identity card or personal identification number is used for agencies, organizations and individuals to check the information of the cardholder in the National Population Database, other national databases and specialized databases according to the provisions of law.
In case the person granted an identity card must present the identity card at the request of a competent agency, organization or individual, that agency, organization or individual shall not request the person granted the card to present documents or provide information that has been printed or integrated into the identity card; in case the information has changed compared to the information on the identity card, the person granted the card must provide documents and papers with legal value proving the information has changed.
- The State protects the legitimate rights and interests of people granted identity cards according to the provisions of law.
