Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy proposed researching, amending and supplementing specific, outstanding and feasible policies to develop digital technology enterprises.
Deputy Prime Minister Le Thanh Long presented to the National Assembly this morning a shortened draft of the Law on Digital Technology Industry. The draft consists of 8 chapters and 73 articles. Creating a favorable environment to nurture digital technology enterprises According to the Deputy Prime Minister, the promulgation of this law aims to develop the digital technology industry into an industry that contributes greatly to the country's economy, creating the most favorable environment to nurture and develop digital technology enterprises. The focus of the industry is Vietnamese digital technology enterprises, gradually shifting from assembly and processing to innovation, design, integration, production, and mastery of core technology in Vietnam; contributing to building a digital government, a driving force for the development of the digital economy and digital society.

“The Law on Digital Technology Industry replaces the contents on information technology (IT) industry and IT services in the Law on Information Technology and supplements new regulations in line with development practices,” said Deputy Prime Minister Le Thanh Long. The viewpoint of law-making is to institutionalize the Party's guidelines and policies and the State's policies on the development of the digital technology industry; overcome current limitations and shortcomings based on analysis and assessment of the current implementation of legal regulations on the IT industry and IT services according to current laws. At the same time, propose feasible policies to specify and create a clear legal corridor, especially for digital technology products and services to promote the development of the digital technology industry; create incentive mechanisms, including investment incentives. AI is one of the most core digital technologies. The draft clearly shows the necessary contents to develop the digital technology industry: Research and development of digital technology; infrastructure, ecosystem, products, services, standards, technical regulations, human resources... for the digital technology industry. According to Deputy Prime Minister Le Thanh Long, the draft has stipulated a number of contents on prioritizing the development of research forces, teams of experts, high-quality researchers; forming modern facilities, research centers, and laboratories. The draft also sets out policies for market development for digital technology enterprises through prioritizing investment, leasing and purchasing domestic products and services. In addition, the draft has policies for developing human resources to meet the quantity and quality requirements of the digital technology industry, focusing on mechanisms to attract high-quality human resources, develop professional human resources; encourage and expand new training models. Deputy Prime Minister Le Thanh Long said that, implementing the Government's direction, based on the actual situation, the Ministry of Information and Communications proposed to supplement the content on digital assets, AI and adjust the content of "semiconductor microchip" to "semiconductor". Regarding the semiconductor industry, this is an important sector of the digital technology industry, relatively complete, highly physical, and large enough in scale. The draft stipulates the chapter "semiconductor industry" instead of "semiconductor microchips" to ensure the comprehensiveness, comprehensiveness, and completeness of the stages of semiconductor industry activities, consistent with the goals, management objects, and synchronization with the semiconductor industry development strategy. Artificial intelligence (AI) is one of the most core digital technologies. The law provides definitions, management and development principles, and assigns the Government to specify this content in detail. According to the principles of AI management and development stated in the draft, AI serving human prosperity and happiness must ensure transparency and explainability, accountability, fairness and non-discrimination, respect for ethical values ​​and help people, protect privacy, inclusive access, security and confidentiality, controllability, risk-based management, responsible innovation and encourage international cooperation. There needs to be a legal basis to regulate artificial intelligence . From the perspective of the reviewing agency, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy said that the Committee basically agrees with the necessity, scope and level of regulations on AI systems in the draft law. "At this time, Vietnam needs a legal basis to regulate artificial intelligence in order to develop the strengths and advantages of AI; at the same time, limit adverse impacts in research, application and development of AI technology," said Mr. Huy.

However, the review agency proposed to study and supplement regulations to limit the risks and impacts of AI technology on economic and social life such as ethical principles; research and development of AI created by Vietnam; allowing businesses with research projects to use data sources from state agencies. The Committee on Science, Technology and Environment also proposed to regulate the level of AI application in state agencies from solutions owned by domestic enterprises, in order to encourage use and create markets. Agreeing with the need for regulations on support and incentives for digital technology enterprises, the review agency proposed to study, amend and supplement specific policies that are superior and feasible; study and promulgate policies to attract foreign investment, capital, and reasonable tax incentives. In addition, it is necessary to study and supplement regulations on the mechanism for allocating state budget resources for research and application of science and technology to state-owned enterprises with sufficient capacity assigned to research and produce key national digital technology products. Regarding the controlled testing mechanism, according to Mr. Le Quang Huy, the Committee for Science, Technology and Environment proposed to study and supplement a number of regulations on testing limits, market protection mechanisms, and consumer protection. "It is necessary to study exemptions from civil, administrative, and criminal liability in testing activities and subsequent activities after the end of testing," Mr. Huy emphasized. The inspection agency also proposed to consider expanding the testing subjects to "digital technology products and services" instead of "digital technology convergence products and services".
