Ministry of Transport speaks out about proposal to stop impounding vehicles violating traffic laws

Recently, a voter in Thanh Hoa proposed amending the regulations on handling administrative violations in the field of traffic, according to which violations should be strictly handled, but people's vehicles should not be detained. The reason given was that the temporary detention of vehicles, in many cases, has caused inconvenience and difficulties for vehicle owners.

Responding to this issue, the Ministry of Transport cited the provisions of Clause 1, Article 125 of the Law on Handling of Administrative Violations. Accordingly, the temporary detention of exhibits, means, licenses or practice certificates is only applied in some cases of real necessity. Specifically, this is to verify the details of the case, prevent violations that may cause serious consequences, or ensure the enforcement of administrative sanction decisions.

The Ministry of Transport has just responded to the proposal to remove the regulation on impounding vehicles in violation.

In addition, the Ministry also clarified the provisions in Clause 10, Article 125, allowing individuals or organizations that violate the law with a clear address and the ability to maintain the vehicle to be able to keep the violating vehicle under the supervision of state agencies. This means that, if qualified, the vehicle owner will not need to hand over the vehicle to the authorities but can continue to keep his vehicle, provided that he posts a bail.

The Ministry of Transport affirmed that the regulation on temporary detention of vehicles violating administrative regulations is a measure to prevent and ensure the effective handling of traffic violations. However, the Ministry also noted the opinions of voters and pledged to continue to study and amend related regulations to ensure strict handling of violations while not causing too many difficulties for the people.

At the same time, the Ministry also said that on June 27, 2024, the 15th National Assembly passed the Law on Road Traffic Order and Safety. Currently, the Ministry of Public Security is presiding over the drafting of a Decree related to administrative sanctions for violations in the field of road traffic. The Ministry of Transport will closely coordinate with the Ministry of Public Security to review and complete these regulations, ensuring fairness and transparency in handling violations and the rights of the people.

The amendment to the regulation on temporary detention of vehicles violating traffic laws promises to bring about positive changes in the handling of traffic violations, both ensuring traffic safety and creating convenience for people and businesses in preserving and using their vehicles.
