(Dan Tri) - By the end of October 30, tax offices in Ho Chi Minh City closed the books to receive documents to determine financial obligations regarding land.
The Ho Chi Minh City Tax Department has just issued a document guiding the implementation of Decision 79/2024 of the City People's Committee on applying the new land price list.
Accordingly, the time for calculating land use fees and land rent (in case of changing land use purposes and recognizing land use rights) will be implemented according to the provisions of the 2024 Land Law, the effective date of the land price list according to Decision No. 79 of the Ho Chi Minh City People's Committee. That is, the application of the new land price list will start from tomorrow (October 31).
The Tax Department also noted that from August 1, when determining household financial obligations, there will be no distinction between land prices within and outside the limit; values greater than VND30 billion will not be considered, and there will be no more cases of applying specific land prices.

Regarding the policy of collecting land use fees and land rent, it complies with the provisions of Decree No. 103/2024 of the Government, effective from August 1. Accordingly, land use fees when changing land use purpose to residential land are equal to land use fees of the land type after changing land use purpose minus land use fees and land rents of the land types before changing land use purpose (if any).
Calculating land use fees when recognizing land use rights is applied according to Articles 9, 10, 11, and 12 of Decree No. 103/2024. However, the City Tax Department also noted that the percentage of land use fees varies in each specific case depending on the time of commencement of land use, the actual type of land in use, and whether there is a violation of land use laws or not.
In case there is not enough basis to calculate land use fees and other payable amounts, within 5 working days from the date of receiving the dossier, the tax authority must notify in writing the Land Registration Office or the competent land management agency or the inter-connected one-stop department. At the same time, notify in writing the District People's Committee (in case there is a request to deduct compensation, support and resettlement expenses) to supplement the dossier.
After receiving all valid documents, the tax authority must issue a notice of land use fee payment and a decision to reduce land use fee (if eligible for land use fee reduction) no later than 5 working days from the date of receiving all additional documents.
The new land price list issued by Ho Chi Minh City will be effective until December 31, 2025. The highest recorded land price is 687 million VND/m2, in the area of Dong Khoi, Le Loi, Nguyen Hue streets (District 1). This price is 4 times higher than the current price list.
According to the representative of the Department of Natural Resources and Environment of Ho Chi Minh City, the new land price list has many benefits. Fees, taxes, land use fees and financial obligations on land of land users, including organizations and individuals, especially households and individuals, are made public, transparent and fair.
Penalties for land violations have increased, contributing to deterrence and reduction of violations, contributing to cleaning up and developing the real estate market in a healthy manner.
Determining the starting price for auctioning land use rights in land plots with completed technical infrastructure is done faster and creates conditions to improve access to land for individuals and organizations in need.
For people whose land is recovered, the determination of resettlement prices will be more public, transparent and faster than before, ensuring fairness in land recovery prices and resettlement land sale prices.
