In the Report on responding to voters' petitions after the 12th session of the 16th People's Council (attached with document 3405/UBND-TH dated October 13, 2023), the Hanoi People's Committee responded to the petitions of Hoai Duc district voters related to the mechanism and policies for handling remaining residential and agricultural land plots after recovery to implement the Ring Road 4 construction project but not eligible for use.
Voters in Hoai Duc district believe that for the remaining residential and agricultural land plots after recovery with an area of less than 30 square meters that are not suitable for living or production, the city needs to have a suitable solution to avoid the situation of super-deformed and super-thin houses appearing after the road is completed.
Hanoi City People's Committee said that Article 5, Decision No. 15/2011/QD-UBND dated May 6, 2011 of Hanoi City stipulates the principles for implementing investment projects to build new traffic routes, deployed after the effective date of this decision as follows: "When making detailed plans and establishing investment projects to build traffic works, the People's Committees of districts, towns and cities are responsible for coordinating with investors of projects to synthesize, compile statistics, and clearly determine the boundaries and areas of land plots adjacent to and outside the road opening boundary but do not meet the construction site conditions to serve as a basis for making a master plan for compensation, support, and resettlement...".
On October 20, 2022, the Hanoi People's Committee issued Decision No. 3956/QD-UBND promulgating a number of additional mechanisms and policies for compensation, support and resettlement when implementing the Ring Road 4 - Capital Region Investment Project (section in Hanoi). Clause 7, Article 1 stipulates land recovery in cases where the conditions for housing construction are not met as follows: "The People's Committees of districts, towns and cities shall recover land plots with a depth of less than 3m; this area shall be immediately updated to the land recovery boundary, and site clearance costs shall be included in the total investment of the project. The People's Committees of districts and towns are responsible for managing and proposing a plan for using this area".
Regarding agricultural land plots, the City People's Committee said that in Clause 6, Article 1, Decision No. 3956/QD-UBND promulgating additional mechanisms and policies for compensation, support and resettlement when implementing the investment project to build Ring Road 4 - Capital Region (section in Hanoi city) stipulates compensation and support for the remaining land area after recovery that is not eligible for continued use as follows: "Compensation and support shall be implemented for the remaining land area after recovery that is not eligible for continued use according to the policy approved by the City People's Committee for projects invested by Hanoi Electricity Corporation in Official Dispatch No. 5457 dated October 30, 2017 of the City People's Committee. The People's Committees of districts and towns are responsible for managing and proposing plans for using this area".
Hanoi City People's Committee requests Hoai Duc District People's Committee to base on the above regulations to implement according to regulations.
