Prosecuted and detained after 4 days of retirement

Just 4 days after officially retiring (January 1), Mr. Hoang Quoc Vuong (60 years old), former Deputy Minister of Industry and Trade, was prosecuted and temporarily detained by the Ministry of Public Security's Security Investigation Agency for the crime of abusing his position and power while performing official duties.

Former Deputy Minister of Industry and Trade Hoang Quoc Vuong

Mr. Hoang Quoc Vuong was appointed as Deputy Minister of Industry and Trade twice. The first time was in October 2010, when Mr. Hoang Quoc Vuong was appointed as Deputy Minister of Industry and Trade by the Prime Minister.

In September 2012, Mr. Hoang Quoc Vuong received the decision to leave the Ministry of Industry and Trade to hold the position of Chairman of the Board of Members of Vietnam Electricity Group (EVN). In January 2015, Mr. Hoang Quoc Vuong was transferred back to work as Deputy Minister of Industry and Trade.

As Deputy Minister of Industry and Trade from 2015 to 2020, Mr. Hoang Quoc Vuong was assigned to be in charge of advising on the development of policies and mechanisms for the electricity sector, renewable energy and sustainable development; directly directing the Electricity Regulatory Authority, the Department of Local Industry, the Department of Industrial Safety Techniques and Environment, etc.

According to the announcement of the conclusion of the inspection of compliance with policies and laws in the management and implementation of planning and investment in the construction of power projects according to the Power Plan VII and the adjusted Power Plan VII, announced by the Government Inspectorate on December 27, 2023, the Ministry of Industry and Trade had many shortcomings and violations in advising and implementing Decision 11.2017 on approving additional solar power projects; Decision 13.2020 on the incentive mechanism for preferential prices (FIT) for solar power... This was also the time when Mr. Hoang Quoc Vuong was Deputy Minister of Industry and Trade.

Consulting on illegal policies, causing huge damage

According to the conclusion of the Government Inspectorate, in implementing Decision 11.2017, the Ministry of Industry and Trade approved and advised the Prime Minister to approve 154 additional solar power projects with a total capacity of 13,837 MW without any basis or legal basis for planning.

Of which, the Ministry of Industry and Trade approved 123 projects with a total capacity of 8,496 MW with an operational schedule in the period of 2016 - 2020, which is the main cause of the imbalance between sources and grids, imbalance in power source structure and regions, causing difficulties in the management and operation of the power system, causing waste of social resources...

Accordingly, the Ministry of Industry and Trade showed lax management, showing signs of the crime of lack of responsibility causing serious consequences as prescribed in Article 360 ​​of the 2015 Penal Code (amended and supplemented in 2017).

The Ministry of Industry and Trade is primarily responsible for advising the Prime Minister to issue the content of Clause 3, Article 5 of Decision No. 13/2020/QD-TTg, which is contrary to the content of Resolution No. 115/NQ-CP dated August 31, 2018 of the Government and inconsistent with the content of the conclusion and direction of the Prime Minister in Notice No. 402/TB-VPCP dated November 22, 2019 of the Government Office, increasing the cost of purchasing electricity and reducing EVN's profits.

In addition, the Ministry of Industry and Trade advised the Prime Minister to issue the content of Clause 1, Article 5 of Decision No. 13/2020/QD-TTg which is inconsistent with the content of the conclusion and direction of the Prime Minister in Notice No. 402/TB-VPCP dated November 22, 2019 of the Government Office.

The Government Inspectorate has forwarded information, along with documents, to the Ministry of Public Security for consideration by the Ministry of Industry and Trade in issuing guidelines and advising on the issuance of a mechanism to encourage the development of rooftop solar power with loopholes, shortcomings, and violations, leading to many systems and clusters of systems being invested in and built quickly with large capacity (approximately 1 MW) on agricultural and forestry land with large areas under the model of investing in farms, violating planning and land use plans, but enjoying the preferential FIT price mechanism of 8.38 UScent/kWh, applied for 20 years.

Previously, at the 34th session (from December 18 to 20, 2023), the Central Inspection Committee reviewed the inspection results when there were signs of violations against the Party Committee of the Ministry of Industry and Trade during the 2016 - 2021 and 2021 - 2026 terms.

The Central Inspection Commission found that the Party Committee of the Ministry of Industry and Trade lacked responsibility, loosened leadership and direction, allowing many organizations and individuals to commit serious violations in advising and promulgating mechanisms for developing solar and wind power; in implementing the adjusted Power Plan VII... The above violations caused serious consequences that were difficult to overcome; and posed a risk of huge losses of money and assets of the State.

According to the Central Inspection Commission, the responsibility for the above shortcomings and violations belongs to the Party Committee of the Ministry of Industry and Trade for the 2016-2021 and 2021-2026 terms and related individuals, including former Deputy Minister of Industry and Trade Hoang Quoc Vuong.
