Accordingly, the Ho Chi Minh City Inspectorate will inspect the Department of Education and Training in implementing the law on inspection, receiving citizens, handling petitions, complaints and denunciations; and financial management and use in the 2021-2022 period.
Shortcomings of the Department of Education and Training of Ho Chi Minh City from the inspection conclusion
The conclusion of the inspection of the Department of Education and Training is stated as follows:
Regarding citizen reception: The Department's citizen reception room on the 1st floor (about 6 m2 ) does not ensure citizen reception in cases where many citizens come to work together. The Department's leaders received a total of 14 citizens in 2021-2022, which does not ensure the number of citizen reception sessions according to regulations.
Regarding financial disclosure: The Department of Education and Training still has limitations and shortcomings in monitoring, managing, compiling statistics and synthesizing financial disclosure at the Department and its affiliated units. This leads to many units still not ensuring full implementation of financial disclosure in accordance with regulations.
The Department of Education and Training has not yet provided instructions on how to handle the collection and payment of VND 590,859,944 from the activities of the after-school cultural center to teach students at Cu Chi High School.
Regarding the implementation of the policy of cashless payment: Some affiliated units still collect fees in cash, have not yet collected tuition fees and other fees by cashless payment method, which is not seriously implemented in accordance with the spirit of Resolution No. 02/NQ-CP and Decision No. 241/QD-TTg of the Government.
Receiving, managing and using sponsorships and aid: The Department of Education and Training has not updated timely the data arising in the monitoring, management, statistics and synthesis of the situation of receiving sponsorships and aid at affiliated units. In fact, 5/7 randomly inspected units have not fully implemented Circular No. 16 and have not properly applied Circular No. 55. There are still some schools that receive authorization from the parent representative committee to collect, manage and use the parent fund.
The implementation of handling and arranging housing and land facilities according to the provisions of Decree No. 67/2021/ND-CP of the Government and the management of the use of public assets for leasing and association purposes for affiliated units: The Department of Education and Training did not have written opinions expressing its opinions on the projects to use public assets of affiliated units, which is not in accordance with the direction of the City People's Committee.
Le Quy Don High School (District 3) is one of 7 schools that the City Inspectorate inspected regarding the use of public assets.
While waiting for approval of the project on using public assets, the schools inspected in 2021 and 2022 that signed contracts and appendices to extend lease and association contracts that had not been through bidding or auction or had been through auction but did not re-auction at the end of the school year but continued to extend the contract were Le Quy Don High School, Nguyen Thi Dinh High School for the Gifted, Cu Chi High School...
Leasing and associating to perform ATM service activities at Ho Chi Minh City College of Economics and Technology, tea and cake shops, photocopy shops, and renting classrooms and computer rooms at Nguyen Thuong Hien High School are not in accordance with the direction of the City People's Committee.
Propose solutions and corrections to shortcomings and violations
Also in the above inspection conclusion, the Chairman of the City People's Committee assigned the Director of the Department of Education and Training to organize a review of the responsibilities of the Department's leadership, departments, offices, principals of inspected units and collectives and individuals related to the content of the inspection conclusion according to their management authority. Propose solutions and corrections for the shortcomings and violations mentioned in the inspection conclusion.
Urgently rectify and overcome limitations and shortcomings in inspection work, citizen reception, petition handling, complaint and denunciation settlement; monitoring inspection team activities, recording inspection team logbooks, enhancing proactive inspection, detection and sanctioning of administrative violations in the education sector.
Research and arrange citizen reception rooms to ensure that they meet the requirements for citizen reception. Issue regulations on citizen reception according to current regulations. Strengthen inspection and examination of the responsibilities of heads of departments, offices, and schools under the Department in receiving citizens, handling petitions, resolving complaints, denunciations, reflections, and recommendations.
Strengthen leadership, direction, inspection, supervision and seriously organize and fully implement measures on financial transparency and publicity. Guide units under the Department in managing and using state budget funds, tuition fees, career revenues and other revenues.
Direct school principals to correct shortcomings and violations through inspection. Learn from experience and rectify units that have not been inspected, rectify the management of receiving sponsorships and aid, cash management, and comply with reporting regulations at affiliated units according to regulations.
Urgently review according to the inspection conclusion, re-count all houses and land facilities that the Department and its affiliated units are managing and using to clearly classify the list of houses and land to synthesize and propose to the City People's Committee.
Review the legal basis for leasing and association of affiliated units while waiting for approval of the Project on using public assets (including the legal basis for leasing football fields outside the sports stadium); review the amount of money that 7 affiliated units have not implemented in accordance with the direction of the City People's Committee.
Carry out budget payment procedures for the collection and payment of VND 590,859,944 at Cu Chi High School according to regulations.
In the inspection conclusion of the Department of Education and Training, it was pointed out that the city's leaders requested the department to issue a document to rectify the collection of tuition fees, collection of agreed fees, collection and payment on behalf of other units, and other revenues at affiliated units to closely manage, monitor, and promptly reflect on accounting books in accordance with regulations.
