From June 1, 2024, changing a driver's license will only take a maximum of 5 days

Circular 05/2024/TT-BGTVT officially takes effect from June 1, 2024, amending the Circular related to the field of road transport, road transport support services, vehicles and drivers issued by the Minister of Transport.

Accordingly, amend and supplement Clause 8, Article 37 of Circular No. 12/2017/TT-BGTVT (amended and supplemented at Point b, Clause 6, Article 2 of Circular No. 01/2021/TT-BGTVT; Clause 1, Article 12 of Circular No. 05/2023/TT-BGTVT) as follows:

“8. Procedures for changing driving license:

a) The Department of Transport shall check the dossier upon receipt; in case the dossier is not in accordance with regulations, it must notify the individual directly or in writing or via the online public service system of the contents that need to be supplemented or modified within 02 working days from the date of receipt of the dossier;

b) Individuals submitting applications directly are responsible for fulfilling the obligation to pay the driver's license fee when their application is received according to regulations; when submitting applications via the online public service system, they must fulfill the obligation to pay the driver's license fee through the payment function of the online public service system according to regulations and pay fees for other services according to the individual's needs;

c) Within 05 working days from the date of receiving a complete application in accordance with regulations (including authentication of electronic identification accounts via the electronic identification and authentication system), the Department of Transport shall carry out the change of driving license; in case the driving license is not changed, a response must be given stating the reason;

d) The driving license issuing agency shall store the original driving license exchange records issued by the Department of Transport (except for driving license exchange via the online public service system); copies of driving license exchange records or foreign driving licenses, driving licenses issued by the Public Security Department, military driving licenses issued by the Ministry of National Defense within 02 years from the date of issuance of the driving license. Cut off the corner of the old driving license (except for driving licenses issued by foreign countries), and hand it over to the driver for safekeeping (in the case of online driving license exchange, the driver is responsible for sending the old driving license to the driving license issuing agency for cancellation according to regulations);

d) In case the driver needs to change the driving license to a lower class, he/she must clearly declare in the Application for changing (re-issuing) the driving license specified in Appendix 19 issued with this Circular and be responsible for the declared content.”.

Cases of driver's license revocation from June 1

Circular 05/2024/TT-BGTVT has added cases where drivers will have their driving licenses revoked, specifically as follows:

First, the driver committed fraud to obtain a driver's license.

Second, the driver erases, deletes, or falsifies information on the driver's license.

Third, let others use your driver's license.

Fourth, the competent authority grants to ineligible persons.

Fifth, there is an error in one of the following information: full name, date of birth, nationality, place of residence, driver's license class, issuance value, date of passing, signatory.

Sixth, through a health examination, the competent authority determines that the driver's body contains drugs (except for the handling acts prescribed in Point c and Point d, Clause 10, Article 5; Point h and Point i, Clause 8, Article 6, Decree 100/2019/ND-CP).

Regarding the procedure for revoking a driving license, according to Clause 15, Article 33 of Circular 12, amended in Circular 05, the competent authority issuing the driving license shall revoke it in the following order:

The head of the competent authority that issues driving licenses shall issue a decision to revoke and cancel driving licenses. The content of the decision shall clearly state the reasons for revocation and cancellation.

Within 5 working days from the date of receipt of the decision to revoke the driving license, the driver must submit the revoked driving license to the driving license revocation agency and the competent authority that issues the driving license is responsible for revoking the issued driving license and canceling it according to regulations.

In case the competent authority that issues driving licenses has merged, divided, separated, or dissolved, the competent authority that revokes or cancels driving licenses is the authority that is managing the original book that issued the driving licenses.
