On September 13, the Supreme People's Procuracy issued an indictment to prosecute 13 defendants in the case of "Violating bidding regulations causing serious consequences", "Giving bribes", "Receiving bribes", "Abusing positions and powers while performing official duties" occurring at the Department of Health of Bac Ninh province and Tien Bo Quoc Te Joint Stock Company - AIC.
In the case, the prosecution agency prosecuted defendant Nguyen Nhan Chien, former Secretary of the Bac Ninh Provincial Party Committee, for "Receiving bribes".
Three other defendants were prosecuted for the same crime: Nguyen Tu Quynh, former Chairman of the Provincial People's Committee; Nguyen Hanh Chung, former Vice Chairman of the Provincial People's Council; and Tran Van Tuynh, former Director of the Bac Ninh Provincial Medical Construction Project Management Board.
In particular, defendant Nguyen Thi Thanh Nhan, former Chairwoman of the Board of Directors and General Director of AIC Company (who is currently on the run) was prosecuted for “Giving bribes”. Defendant Nguyen Tien Nhuong, former Vice Chairman of the People’s Committee of Bac Ninh province, was prosecuted for “Abusing position and power while performing official duties”. Along with that, 7 others were prosecuted for “Violating bidding regulations causing serious consequences”.
The indictment shows that defendant Nguyen Nhan Chien was Chairman of the People's Committee of Bac Ninh province from 2011 to 2015 and Secretary of the Provincial Party Committee from 2015 to 2020. Around mid-2013, before implementing 6 medical equipment procurement packages in Bac Ninh, defendants Nguyen Hanh Chung, Tran Van Tuynh and La Tuan Hung (General Director of Song Hong Corporation) met defendant Nguyen Nhan Chien.
At the meeting, Mr. La Tuan Hung proposed to defendant Chien to support the province in requesting additional government bond capital to continue implementing unfinished projects, including 6 district-level general hospital projects. In return, after the approval of the allocation of additional capital, the Song Hong Company group won the bids for purchasing medical equipment for 6 district-level general hospitals.
Defendant Nguyen Nhan Chien agreed and directed defendants Tran Van Tuynh and Nguyen Hanh Chung to report to Nguyen Tu Quynh and Nguyen Tien Nhuong. Defendant Tran Van Tuynh continued to report and defendants Quynh and Nhuong agreed. After that, defendant Nguyen Thi Thanh Nhan also contacted defendant Tran Van Tuynh to request support for requesting additional funding for Bac Ninh province. The conditions were the same as the Song Hong Company group, requesting to win the bid for 6 medical equipment packages.
The prosecution agency accused that the Song Hong Company group and the AIC Company group were divided and won 6 medical equipment supply packages, causing losses to the State budget of more than 48 billion VND. During that process, defendant Nguyen Thi Thanh Nhan repeatedly came to the office to give gifts to defendant Nguyen Nhan Chien.
Specifically, after finalizing the medical equipment procurement packages, on holidays and Tet from 2015-2017, defendant Nguyen Thi Thanh Nhan gave money to defendant Chien many times, a total of 3 billion VND. Song Hong Company Group also gave money to defendant Tran Van Tuynh to transfer to defendant Chien 5 times, a total of 1 billion VND.
During the investigation, defendant Nguyen Nhan Chien confessed that during the period of 2014 - 2020, on holidays and Tet, defendant Nguyen Thi Thanh Nhan met and gave cash gifts with a total of 10 billion VND. Defendant Chien said he used the money he received for personal purposes.
According to the indictment, the AIC and Song Hong companies also paid money to thank defendant Nguyen Tu Quynh many times. Accordingly, defendant Quynh received money 5 times at the office, totaling 1 billion VND from defendant Tran Van Tuynh. This was the amount of money that the Song Hong company group asked defendant Tuynh to thank his superiors.
In addition, during the investigation, defendant Nguyen Tu Quynh also confessed that during the period 2013-2019, on holidays, defendant Nguyen Thi Thanh Nhan repeatedly went to the office of the former provincial chairman to give a total of 8.1 billion VND.
Each time, defendant Nhan gave from 300 million to 2 billion VND. During the investigation, both defendant Nguyen Nhan Chien and defendant Nguyen Tu Quynh returned the entire amount they received to remedy the consequences.
On the basis of exercising the right to prosecute and supervise the settlement of cases, the Supreme People's Procuracy recommends that among the causes and conditions for the crimes committed by the defendants, there are causes stemming from violations and shortcomings in the management, inspection and supervision work of the Ministry of Finance, departments, branches and the People's Committee of Bac Ninh province.
To limit the loss and damage of State assets and limit violations by organizations and individuals, the prosecution agency recommends competent authorities to handle administrative procedures and rectify bidding activities for the procurement of medical equipment.
