NDO - On November 9, continuing the program of the 8th session of the 15th National Assembly, authorized by the Prime Minister, Minister of Education and Training Nguyen Kim Son presented a report on the draft Law on Teachers, which proposed many preferential policies on salary as well as retirement age for teachers.
Presenting the Draft Law on Teachers at the meeting, Minister of Education and Training Nguyen Kim Son said that the Draft consists of 9 chapters and 50 articles.
Compared with current regulations in related Laws such as the Law on Civil Servants, the Law on Education, the Law on Higher Education, the Law on Vocational Education, the Labor Code, the draft Law on Teachers has some new points as follows:
The subjects and scope of application of the Law on Teachers are teachers in educational institutions in the national education system, including teachers in public educational institutions and teachers in non-public educational institutions.
Standardize the teaching staff through a system of titles and professional standards for teachers with standards closely following the requirements of professional capacity associated with each level of education and training. Teachers in non-public educational institutions are equal to teachers in public educational institutions in terms of identification, professional standards, basic rights and obligations, and a number of policies such as training, fostering, honoring, rewarding, and handling of violations.

Delegate the initiative to the education sector in recruiting and using teachers. In which, the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs are the agencies in charge of developing strategies, projects, development plans, and total staffing levels of teachers under their management authority to submit to competent authorities for decision; coordinate the staffing levels of teachers in public educational institutions according to the number assigned by competent authorities; education management agencies or educational institutions take the lead in recruiting teachers.
According to Minister of Education and Training Nguyen Kim Son, the promulgation of the Law on Teachers aims to perfect the legal system on teachers, and at the same time have specific policies to build and develop the teaching staff; overcome current shortcomings in state management of teachers, and create breakthrough policies to develop the teaching staff.
“With the promulgation of the Law on Teachers, teachers in public educational institutions are special civil servants, enjoying all the rights and policies for civil servants in the legal system, and at the same time having a number of special policies to have better development opportunities,” said Minister Nguyen Kim Son.
Regulations on teacher recruitment ensure that there must be pedagogical practice in order to select people with sufficient capacity in accordance with teacher professional standards, meeting the requirements of teacher professional activities at each level of education, training level, etc.
Teachers' salary policy is prioritized. In particular, the basic salary according to the teachers' salary table is ranked highest in the administrative career salary scale system; teachers are entitled to preferential allowances for their profession and other allowances depending on the nature of their work and the region as prescribed by law. Teachers continue to receive seniority allowances until the salary policy according to Resolution 27-NQ/TW is implemented.
Preschool teachers; teachers working in extremely difficult areas in ethnic minority areas, mountainous areas, coastal areas and islands; teachers in specialized schools and other specialized schools; teachers implementing inclusive education; teachers who are ethnic minorities and teachers in some specific professions are given priority in terms of salary and allowances compared to other teachers. Teachers recruited and paid for the first time are given a 1-level salary increase in the administrative and career salary scale system.
Teachers working in ethnic minority areas, mountainous areas, border areas, islands and areas with especially difficult socio-economic conditions; teachers in specialized schools, teachers of inclusive education; teachers of ethnic minority languages; teachers of Vietnamese language enhancement for ethnic minority students; teachers of gifted subjects and arts are entitled to a number of other support policies.
The retirement age of teachers is regulated separately according to the characteristics of their professional activities. In particular, teachers in preschools, if they wish, can retire at a lower age but not more than 5 years older than the regulation and will not have their pension rate deducted due to early retirement. Teachers with the title of professor, associate professor or doctoral degree and teachers working in specific specialized fields and sectors are entitled to retire at a higher age.
Approve policies to prioritize, support and attract teachers
Presenting the review report, Chairman of the National Assembly's Committee on Culture and Education Nguyen Dac Vinh agreed with the necessity of developing the draft Law on Teachers and said: The promulgation of the Law on Teachers aims to institutionalize the Party's viewpoints and policies on teachers; contribute to perfecting the legal system, promptly supplementing new and specific policies to build and develop the teaching staff.
The Committee also agreed with the provisions in the draft law on salaries and allowances for teachers as well as policies to prioritize, support and attract teachers.
Regarding the retirement regime for teachers, the committee agreed to stipulate that teachers in preschools can retire at a lower age (no more than 5 years) than the provisions of the Labor Code and will not have their pension rate deducted due to early retirement. However, there are opinions suggesting that it is necessary to carefully assess the impact on resources to ensure the implementation of this policy...
However, there are opinions suggesting to study and properly implement the spirit of the Party's Resolution on reforming salary policy; consider regulating salary policy for teachers in the non-public sector; not to re-regulate the policy of renting public housing as stipulated in the Housing Law.

In addition, the review agency believes that it is necessary to carefully assess the impact to ensure feasibility, especially in terms of resources for implementing the policy of ensuring collective accommodation for teachers when working in rural areas.
The Committee on Culture and Education agrees with the regulations on the duties and powers of the Ministry of Education and Training and the Ministry of Labor, War Invalids and Social Affairs in state management of teachers and believes that this is a new policy, creating conditions for the education sector to be proactive in mobilizing, rotating, and arranging teachers between localities; overcoming the situation of local surplus and shortage of teachers. However, it is recommended to consider assigning authority to these agencies in presiding over and coordinating the work of teachers in schools of the people's armed forces.
