On the afternoon of May 30, the National Assembly discussed in groups the draft resolution on taking a vote of confidence for people holding positions elected or approved by the National Assembly or People's Council (amended).
Discussing at group 12, delegate Vu Hong Luyen (Hung Yen delegation) said that it is still necessary to take a vote of confidence for people waiting to stop working or retire.
According to her, according to the Law on Civil Servants and Public Employees, civil servants will receive a written notice of retirement 6 months before retirement. A retirement decision will be issued 3 months in advance.
Therefore, when notified of retirement, this person still has a maximum of 6 months of work left, with 3 months left before receiving the retirement decision.
"In 3 months, this person is still running all the work, the vote of confidence is still appropriate. The person who is voted for will have a basis to self-evaluate, self-reflect, and self-correct," said delegate Luyen.

According to delegate Hoang Duc Thang (Quang Tri delegation), taking a vote of confidence is not only to evaluate officials, but also to carry out the next steps such as removing them from the planning, dismissing them, and assigning them to other jobs lower than their current positions for those with low confidence.
He also commented on the regulations on prohibited acts, including "using or promising to donate, give, or support money, property, or material benefits to lobby, entice, or bribe National Assembly deputies and People's Council deputies in taking a vote of confidence or voting for confidence."
Considering this provision is not enough, Mr. Thang proposed adding "material benefits and other benefits", because there are non-material promises such as promises to remove a position, promises to arrange a certain position or give promotion opportunities with impure purposes.
Clarifying some of the delegates' opinions, Head of the Delegation Work Committee Nguyen Thi Thanh said that the draft has been revised a lot compared to the previous regulations, only retaining 2 out of 22 articles.
She emphasized that the draft resolution was built on the basis of Regulation No. 96 dated February 2, 2023 of the Politburo on taking a vote of confidence for leadership and management positions and titles in the political system.
Therefore, regulations such as taking a vote of confidence once in the middle of the term, not taking a vote of confidence for people who are being treated for serious illnesses and have not been in office for 6 months or more are applied according to Regulation 96.

Regarding the subjects that will not be given a vote of confidence, Ms. Thanh clearly stated that only those with serious illnesses or those who have not been in management for 6 months or more will not be given a vote.
"This is also a new addition compared to Regulation 96. Initially, the drafting committee designed a 3-month time limit, but the consultation process found that this was too short and that 6 months or more was appropriate. Therefore, the drafting committee accepted and included this provision in the draft Resolution," Ms. Thanh explained.
Ms. Thanh added that taking a vote of confidence and a vote of no confidence are two different “steps”. Specifically, a vote of no confidence is the result of taking a vote of no confidence in cases of low confidence from 50% or more to less than 2/3 low confidence. If they do not resign, a vote of no confidence will be taken. Therefore, according to her, a vote of no confidence is essentially a dismissal.
Faced with concerns that the results of the vote of confidence were low, but when the vote of confidence was high, Ms. Thanh said that in practice, summarizing the past three terms, including from the People's Council at the commune level to the National Assembly, there has not been any such case.
Regarding the length of time to resign, Ms. Thanh stated that the draft resolution stipulates that if a person is given a vote of confidence and is rated "low confidence" by more than half to less than two-thirds of the total number of National Assembly and People's Council deputies, he/she must resign. If he/she does not resign, a vote of confidence will be held at that session or the nearest session.
Ms. Thanh believes that there is never a case of a low confidence vote being taken and then changed when it comes to a confidence vote. "This is just one channel to evaluate officials among many other channels," Ms. Thanh said .
