Minister of Home Affairs Pham Thi Thanh Tra: The legal staff is still thin, with shortcomings in mechanisms, policies, and organizational structure.

Answering questions from delegates regarding human resources in the judicial sector, especially the legal staff and appraisers, Minister of Home Affairs Pham Thi Thanh Tra affirmed that this situation is exactly as the delegates have reflected. That is, the force is thin, there are shortcomings in mechanisms, policies, and organizational structure... The Ministry of Home Affairs and the Ministry of Justice have worked to find the causes and solutions to overcome this situation.

According to the Minister of Home Affairs, there are two main reasons, including difficulties in implementing the Party's policy on restructuring the apparatus and reducing staff, so local legal organizations must be reorganized in accordance with the spirit of Resolution 18 of the Central Committee and Decree 107 of the Government. Therefore, the legal department at the Department of Justice has reduced the number of focal points. In addition, in practice, this is a difficult, complicated, sensitive field, with additional resources and recruitment not being favorable due to difficult policies and requirements for deep professional expertise.

Therefore, the Ministry of Home Affairs proposed a number of solutions: The Ministry of Home Affairs and the Ministry of Justice develop a project to develop human resources in the judicial field in general, including the team of legal officers and appraisers for the period 2023 - 2030. In particular, great attention is paid to recruitment, use, and related policies and mechanisms; at the same time, attention is paid to training, fostering, and updating knowledge so that this team can meet the requirements of tasks in the new situation.

Currently, the Ministry of Home Affairs and the Ministry of Justice are completing a circular guiding the job positions and competency framework for legal officers and appraisers to have a basis for determining the staffing in this force.

The Ministry of Home Affairs and the Ministry of Justice are still concerned about the policy for the legal staff and appraisers, because the current policy is not suitable for practical requirements. However, if it is amended now, it will be difficult because it is related to the roadmap and salary reform policies according to Resolution 27 of the Central Executive Committee. Therefore, the Ministry of Home Affairs and the Ministry of Justice agree that when implementing the salary policy reform roadmap, they will introduce a specific policy mechanism for the legal staff and appraisers to suit the nature of this profession.

Regarding decentralization, Minister Pham Thi Thanh Tra affirmed that this is an important task, a great resource and driving force for the country's development. However, the implementation is still facing difficulties and problems related to the institutional system that need to be further adjusted and supplemented. The Prime Minister has issued Resolution No. 04 on decentralization, which amends, supplements and builds new 32 laws; at the same time amends, supplements and promulgates new 35 decrees and 25 circulars. To date, 21 laws related to decentralization and delegation have been amended and supplemented under the direction of the National Assembly and the National Assembly Chairman. Regarding decrees, 19 decrees have been amended and supplemented to date.

Under the direction of the National Assembly Standing Committee, the Ministry of Home Affairs is developing a plan and reporting to the National Assembly to propose amendments to the Law on Government Organization and the Law on Local Government Organization. When these two basic and important laws are amended, along with other laws, decentralization and delegation of power will be promoted.

The Minister also requested that localities, based on Resolution 04 of the Government and the laws promulgated by the National Assembly in recent times, implement decentralization and delegation of power clearly, and need to be bold in implementation.

Regarding the question of the delegates about the situation of officials avoiding and being afraid of responsibility, the Minister said that this issue has been answered very carefully and Minister Le Thanh Long also raised it. With these solutions, the situation of officials avoiding responsibility, not daring to do, not daring to take responsibility will be "destroyed". The Ministry of Home Affairs is finalizing a draft on this issue to submit to the Government for promulgation (expected in August 2023).
