Deputy Prime Minister Tran Hong Ha recently signed and issued Official Dispatch 469 on removing obstacles and promoting the safe, healthy and sustainable development of the real estate market.

The dispatch clearly stated that the real estate market plays an important role in the economic "ecosystem" and is directly related to many economic sectors, affecting the production chain and influencing macroeconomic stability, growth, social security and employment.

Good management and development of the real estate market will create favorable conditions to attract investment, mobilize huge internal resources, and contribute to promoting the country's socio-economic development. However, in recent times, the real estate market has faced many difficulties due to objective reasons.

Faced with that situation, the Prime Minister requested that ministries, branches and localities consider this an urgent and important task that needs to be focused on resolving according to the principle that the problem falls under the authority of which level, that level must resolve it.

Ministries and branches focus on guiding localities on regulations in their fields to resolve current problems, not evasive answers.

Perfecting laws related to real estate

The Ministry of Construction needs to focus on studying and amending the 2014 Housing Law and the 2014 Real Estate Business Law.

Preside over and coordinate with the Ministry of Planning and Investment to guide localities to remove difficulties and obstacles in the preparation and approval of planning; the implementation of planning adjustments; the application of planning levels when approving project investment policies, before June 15, 2023.

Preside over and coordinate with the Ministry of Public Security and relevant ministries, branches and agencies to review difficulties and problems related to fire prevention and fighting in construction works to propose solutions before June 30, 2023.

Regarding difficulties and problems in allocating land funds for social housing development, the Ministry of Construction guides localities to resolve them in accordance with legal regulations and effectively implement the VND 120,000 billion credit program.

The State Bank of Vietnam needs to continue to urge and direct credit institutions to reduce costs to reduce interest rates on deposits and loans; create conditions for real estate project investors and home buyers to access credit sources.

Closely monitor the implementation of credit institutions and foreign bank branches restructuring debt repayment terms and maintaining debt groups to support customers in difficulty and regulate the purchase and sale of corporate bonds by credit institutions and foreign bank branches, to promptly guide and resolve arising problems (if any).

Strengthen inspection and urge credit institutions to implement solutions to support and promote the development of the real estate market.

The Ministry of Natural Resources and Environment must advise and submit to the Government a Decree amending and supplementing regulations on specific land valuation methods, and submit to the Government for promulgation before June 30, 2023.

Direct, urge and guide localities to remove difficulties and obstacles in determining land prices, planning and annual land use plans, especially at the district level, and implementing compensation and site clearance, before June 30, 2023.

Preside over and coordinate with the Ministry of Planning and Investment and relevant ministries and branches to direct and guide localities to remove difficulties and obstacles in the process of equitized enterprises changing land use purposes to implement projects; the transfer of land use rights with infrastructure to people in projects located in wards of special urban areas and type I urban areas.

Need solutions to promote the stock market

The Ministry of Planning and Investment needs to urgently complete the draft Decree amending and supplementing a number of articles of the Decree detailing a number of articles of the Law on Planning and implementing the rights and responsibilities of representatives of state owners.

Preside over and coordinate with the Ministry of Finance, the Ministry of Natural Resources and Environment and relevant ministries, branches and agencies to guide localities to remove difficulties and obstacles for real estate projects implemented under the BT contract form before the PPP Law abolishes the BT contract form and remove difficulties and obstacles in approving and adjusting project investment policies, investment certificates, and adjusting the progress of real estate project implementation.

In addition, the Ministry of Finance needs to promptly have effective solutions to promote the development of a healthy and sustainable stock market; promptly complete the report on the situation of the corporate bond market in 2023, promptly propose practical, feasible and effective solutions to completely handle existing problems and limitations.

Preside over and coordinate with relevant ministries, branches and agencies to direct, urge and guide localities to remove difficulties and obstacles in: conditions for maintaining a capital contribution ratio of no less than 26% when relocating enterprises and production facilities; on plans to rearrange and handle state-owned houses and land (now called houses and land as public assets).

Promote healthy stock market development.

At the same time, the Ministry of Public Security needs to carry out the tasks assigned by the Prime Minister and the Prime Minister's Working Group on reviewing, guiding and removing difficulties and obstacles in implementing real estate projects.

Timely detect and strictly handle violations of the law in construction investment and real estate business activities.

The Ministry of Justice must proactively coordinate and support relevant ministries, branches and agencies in reviewing and classifying existing problems, limitations, obstacles, contradictions or bottlenecks in current institutions, policies and laws that need to be amended, supplemented or newly issued to propose to competent authorities or handle them according to their authority as prescribed by the Law on Promulgation of Legal Documents.

The Ministry of Information and Communications, including media agencies and the press, must strengthen the dissemination of solutions and measures of the Government, the Prime Minister, ministries, branches and localities in removing difficulties and promoting the safe, healthy and sustainable development of the real estate market.

The Government Inspectorate must complete the review file, resolve and remove difficulties and obstacles related to projects and land in the inspection, examination and judgment conclusions in a number of provinces and cities, submit them to the Government Party Committee for consideration and submit them to the Politburo for comments.

Overcoming the fear of responsibility of the People's Committees of provinces and cities

The dispatch clearly stated that the above ministries and branches are responsible for coordinating with relevant ministries, branches, localities and agencies to propose solutions to remove difficulties and obstacles in the real estate market for arising issues that exceed their authority.

In case it is necessary to report and ask for the Prime Minister's opinion, it is necessary to clearly propose solutions and legal basis according to the principle that the problem falls under the authority of which level, that level must resolve it.

The Prime Minister requested the People's Committees of provinces and centrally-run cities to urgently disseminate to each unit, cadre, civil servant and public employee the need to seriously implement the directives; resolutely overcome the situation of avoiding and pushing work, being hesitant, afraid of making mistakes, afraid of responsibility, not daring to advise and propose work handling, shortening the handling time and improving the effectiveness and efficiency of direction and administration.

Strictly handle organizations and individuals who avoid, push away work, shirk tasks, lack responsibility, cause delays or fail to decide on issues and tasks under their authority; rotate and handle cadres who are afraid of making mistakes and being afraid of responsibility in performing public duties. Timely commend and reward collectives and individuals who perform well in their assigned duties and tasks, protect cadres who dare to think and act for the common good.

The Prime Minister called on and requested ministries, branches, localities, people, businesses and relevant entities to join hands and unite to overcome difficulties and challenges, promoting the safe, healthy and sustainable development of the real estate market .
