On the afternoon of September 30, Party Central Committee member, Minister of Natural Resources and Environment Do Duc Duy chaired a thematic conference on law-making, building laws, resolutions, decrees, circulars guiding the implementation of laws and circulars regulating economic-technical norms... of the Ministry of Natural Resources and Environment.

Attending the Conference were Deputy Minister Nguyen Thi Phuong Hoa, Deputy Minister Le Cong Thanh, Deputy Minister Le Minh Ngan and heads of specialized units of the Ministry of Natural Resources and Environment.

Important tasks are prioritized

Speaking at the Conference, Minister Do Duc Duy emphasized that the work of developing and perfecting legal documents (LDOs) of the Ministry is identified as an important task and always a priority. The Minister highly appreciated the Ministry's specialized units for their great efforts to complete a huge amount of work, including the legal documents of the 2024 Land Law taking effect 5 months in advance...

However, through reviewing tasks and comparing plans, Minister Do Duc Duy pointed out that there are still many legal documents that need to be completed by the end of 2024, including documents submitted to all levels and documents issued under the authority of the Ministry.

The Minister requested that specialized units report in detail, state the existing problems and difficulties, and propose recommendations to identify key tasks, complete assigned tasks in 2024 as well as directions for the following years for the Ministry's leaders to resolve and direct implementation.

Reporting at the Conference, Director of the Legal Department Phan Tuan Hung said that according to the 2024 Legal Document Development Program of the Ministry of Natural Resources and Environment, units must develop and submit to the Minister 75 documents (02 Laws, 12 Decrees, 02 Decisions of the Prime Minister and 59 Circulars).

Up to now, all fields of natural resources and environment have been regulated and managed by law at different levels; the system of legal documents on natural resources and environment is basically synchronous, unified and basically meets the requirements of state management; the quality of legal documents in all fields has been gradually improved and enhanced; administrative procedures have been reformed, simplified and achieved many notable results.

However, in addition to the achieved results, Mr. Phan Tuan Hung also pointed out some shortcomings and limitations in the task of developing legal documents such as the quality of some legal documents when implemented still has problems and shortcomings, still needs to be revised and supplemented; some legal regulations still have overlaps and duplications; many new contents and policy tools are effective and successfully applied in the world but have not been researched, proposed, or updated; have not attracted the participation of good experts, managers, and scientists; coordination and participation in the development of legal documents inside and outside the Ministry are still difficult...

In order to overcome the above difficulties to complete the tasks, the Legal Department proposes and recommends that the Minister and Deputy Minister pay attention to and direct a number of contents such as:

Review and organize monthly specialized meetings on law-making to discuss and give opinions on draft legal documents to ensure quality, content and progress; promptly give opinions and instructions on handling difficulties and problems of the unit or issues with different opinions; if necessary, invite experts, scientists and applicable subjects to participate.

Establish and implement a mechanism for regular dialogue between the Ministry and localities, associations, and enterprises to remove obstacles and shortcomings in the implementation of legal documents on natural resources and environment; this can be done simultaneously with the communication of draft legal documents and the training and dissemination of newly issued legal documents.

Assign specialized units to participate in Drafting Committees, Editorial Teams and preside over comments on draft laws and draft legal documents chaired by other ministries and branches to ensure expertise and practicality.

Conduct regular or thematic reviews of legal documents to promptly handle legal provisions with problems and inadequacies and ensure consistency and synchronization of legal documents between the fields of natural resources and environment..., between the fields of natural resources and environment and related laws.

Create a breakthrough mechanism and prioritize the allocation of human resources, resources, and material resources for policy and law making from economic, scientific and technological, and environmental sources, improve the quality of policies and legal regulations, etc.

Also at the Conference, reporting on the implementation of projects of the Ministry of Natural Resources and Environment, the Department of Planning and Finance requested units under the Ministry to promptly review the implementation, propose to cut, integrate or stop performing tasks that are no longer urgent and ensure that they are consistent with the ability to balance the regular budget (especially sources of economic activities).

Urgently complete the dossier to submit to the Ministry for approval or approve according to authority the tasks that have been approved in the list of newly opened professional tasks; Appraise and approve detailed estimates of assigned professional tasks with budget estimates according to authority.

In addition, it is also recommended that the Ministry's leaders continue to propose that the Government consider and direct the Ministry of Finance to allocate funding for specialized technical plans (for 05 river basin master plans that must be submitted to the Government in 2024 according to Resolution 01/NQ-CP of the Government).

At the meeting, Deputy Ministers Nguyen Thi Phuong Hoa and Le Cong Thanh pointed out the current shortcomings of the units and at the same time gave directions to remove obstacles for the units such as Standards and regulations on water resources management; Circulars on technical and economic norms for collection and treatment of domestic solid waste, collection and treatment processes; Key program for investigation of marine environmental resources; Circulars on land investigation and assessment, land use planning; consideration of budget allocation for administrative boundary projects...

Deputy Minister Le Cong Thanh proposed to supplement and improve the reporting process to resolve any problems; Deputy Minister Nguyen Thi Phuong Hoa suggested that units need to coordinate with each other to come up with timely solutions to submit to the Ministry's leaders.

Assessing the shortcomings in the work of building legal documents as well as recording the opinions of the Deputy Ministers, Minister Do Duc Duy pointed out the causes of this issue such as: the volume of tasks to build and complete legal documents is very large, the number of legal documents that are newly built, revised and supplemented every year is large, requiring urgent time. The content of some legal documents is complex, affecting the rights and interests of many subjects in society, creating consensus among relevant parties is very difficult...

Some units have not allocated enough time and resources for the drafting work; the initiative of some units assigned to preside over the drafting is not high; Coordination between the Ministry and other ministries and branches is sometimes not close and consistent; in some cases, proposals for the drafting of legal documents lack scientific and practical basis and lack of forecasting; resources for the drafting of legal documents are limited...

Investing in institutional building to create development momentum

Concluding the Conference, in order to successfully complete the tasks of developing policies and legal documents, Minister Do Duc Duy requested the units of the Ministry to closely follow some key viewpoints and goals:

Emphasizing that policy and institutional building is a breakthrough for the Ministry of Natural Resources and Environment, Minister Do Duc Duy suggested focusing the highest investment on this task to create momentum for development.

The development of legal documents must closely follow Resolution 27/NQ-TW of the Central Committee on Building and Perfecting the Rule of Law State in the New Period, as well as Resolutions of the Government on management and administration.

The next viewpoint is to identify the content of policy and institutional development as a breakthrough step of the Ministry of Natural Resources and Environment, therefore it is recommended to focus the highest investment on this task to create momentum for the development of the country in general and the natural resources and environment sector in particular.

In management work, in addition to strict compliance, it is necessary to advise and propose appropriate policies to create a harmonious and sustainable development mechanism.

Pay attention and focus on researching and applying scientific research results to the development and improvement of laws on natural resources and environment. Exploit achievements of science and technology to innovate methods, shorten processes, improve the quality of drafting, consulting, receiving and revising draft legal documents.

Strengthen the review, inspection and handling of legal documents to detect shortcomings in law enforcement, thereby proposing timely solutions and policy supplements.

In addition to closely following and complying with the above viewpoints, Minister Do Duc Duy also requested that the units of the Ministry in implementing the construction of legal documents should be based on 4 principles as follows:

Firstly, ensure the work of building, reforming and perfecting laws on natural resources and environment in accordance with the socialist-oriented market economic institution; ensure completeness, synchronization, unity, transparency, stability and high feasibility, easy access and enhance connectivity and interoperability among sectors.

Second, resolutely focus on promoting reform and simplifying administrative procedures, taking people and businesses as the center and the objects of service; increase decentralization and delegation of power to localities and grassroots levels; review and eliminate subsidy and request-grant mechanisms, promote socialization and increase mobilization of resources from society in natural resources and environmental management.

Third, focus on removing legal bottlenecks and bottlenecks to create a favorable and open legal corridor for economic development, create a favorable investment and business environment, equality in access to resources and participation in environmental protection among economic sectors, and enhance international integration.

Fourth, prevent corruption, waste, and negativity in resource management and use; enhance the effectiveness of environmental protection and climate change response; promote circular economy, green economy, innovation, and digital transformation in the context of promoting e-Government development and the Fourth Industrial Revolution.

Minister Do Duc Duy said that the above viewpoints and goals will aim to complete the plans for 2024 as well as serve as a basis for preparing for the plans for 2025 as well as the next term.

To complete the above goal, the Minister assigned tasks to each relevant unit to promptly adjust the task plan to submit to the Party Committee for consideration, in which it is necessary to specify each task, responsibilities of relevant parties, and implementation time.

At the same time, proactively contact Government agencies, Ministries, branches, and the National Assembly to ensure that the Ministry's submitted documents are issued promptly.

The Minister also proposed focusing on implementing the 2024 Land Law and strengthening the dissemination of legal policies to remove difficulties for localities.

Minister Do Duc Duy proposed to quickly complete the report on acceptance and explanation of the Project Law on Geology and Minerals as well as draft Decrees and Circulars guiding the plan. In particular, the content on minerals used as filling materials needs to be reviewed so that when the Law is promulgated, it will take effect immediately to resolve this issue for localities.

In the environmental field, it is necessary to complete current legal guidance documents, select a number of policies that are entangled with other legal documents and propose them to the National Assembly for amendment as soon as possible.

Minister Do Duc Duy requested the Department of Planning and Finance to review and clearly define the list, closely following other specialized laws to complete the industry's economic regulations, standards and norms.

Minister Do Duc Duy agreed with the recommendations and proposals of the Legal Department on strengthening coordination in drafting legal documents, disseminating laws; promoting scientific research, learning from international experiences...

The Minister requested units such as Legal Affairs, Planning - Finance, and Personnel Organization to quickly advise and propose solutions to improve and supplement the capacity of the staff performing legal tasks, creating conditions to enjoy the highest policies according to the provisions of law.
