Accordingly, the Provincial People's Committee assigned the Department of Natural Resources and Environment (DONRE) to preside over and coordinate with relevant sectors, localities and units to further improve the professional quality in the appraisal of mineral exploration projects and appraisal, approval and confirmation of mineral reserves for mineral exploration result reports under the licensing authority of the Provincial People's Committee; improve the quality of appraisal of environmental impact assessment reports, correctly and fully calculate the cost of environmental rehabilitation and restoration deposits in mineral exploitation activities.
In addition, closely monitor and supervise the location, output of exploited minerals, mining capacity, and permitted mineral reserves of mineral mine owners after being granted mining licenses according to regulations; promptly inspect, examine, and strictly handle violations in accordance with the provisions of law.
Assign the People's Committees of districts, towns and cities to direct the Department of Natural Resources and Environment to organize a comprehensive inspection and review of the current status of compliance with mineral laws by all units licensed to operate minerals in the management area (including location, boundaries of mining areas; output, mining capacity, permitted mining reserves; invoices, purchase and sale documents, tax declarations to control annual mining output...); handle violations in accordance with the provisions of law; difficulties and obstacles in state management of minerals in the locality and make proposals and recommendations; report the implementation results to the Department of Natural Resources and Environment before December 31, 2023 for synthesis and reporting to the Provincial People's Committee and the Ministry of Natural Resources and Environment.
The People's Committees of districts, towns and cities and the Provincial Police, the Police of districts, towns and cities must regularly monitor, promptly detect and take resolute and decisive measures to prevent the recurrence of illegal mineral exploitation activities; especially illegal gold, sand and gravel mining, illegal soil and stone mining in the management area.
The Provincial People's Committee directs relevant departments, branches and People's Committees of districts, towns and cities to continue to seriously implement the direction of the Provincial People's Committee in Official Dispatch No. 4334/UBND-KTN dated July 5, 2022 on strengthening coordination, improving the effectiveness and efficiency of state management of minerals. During the implementation process, if there are any difficulties or problems in the management and handling of violations in the field of minerals, promptly report and propose to the Department of Natural Resources and Environment for synthesis and advice to the Provincial People's Committee to request competent authorities to consider, amend and adjust legal provisions to suit the practical management work and the specific nature of mineral activities.
