Immediately after the closing of the 6th Session, on the morning of November 29, Secretary General of the National Assembly Bui Van Cuong chaired a press conference to announce the results of the 6th Session of the 15th National Assembly.

At the press conference, press agencies raised questions related to the many conflicting opinions of National Assembly deputies on the regulation of "zero alcohol concentration" when driving stipulated in the draft Law on Road Traffic Order and Safety.

Regarding this issue, Deputy Chairman of the National Assembly's Defense and Security Committee Nguyen Minh Duc said that the draft Law on Road Traffic Order and Safety stipulates an absolute ban on breath alcohol. The Law on Prevention and Control of Alcohol Harm, Clause 6, Article 5 stipulates prohibited acts, including an absolute ban on drinking alcohol before and while driving.

Mr. Nguyen Minh Duc said that in principle, in the legal system of Vietnam, all laws need to be unified. The next law should be built based on the source of the previous law. Based on the source of the Law on Prevention and Control of Alcohol Harm, the drafting agency and the reviewing agency have proposed the above content in the Law on Road Traffic Order and Safety.

Of course, the opinions of the National Assembly deputies through discussion, the most complete and thorough assessment. The viewpoint of the examining agency is completely in agreement with the drafting agency that is to comply with the provisions of the legal system.

At the same time, based on the annual assessment and inspection of traffic safety implementation by the National Defense and Security Committee, the summary shows that 43% of road traffic accidents are caused by alcohol.

“I think this is an order and needs to be implemented. We hope that the press will propagate to change awareness and that people will support it. We believe that the National Assembly will basically agree to this content,” Mr. Nguyen Minh Duc emphasized.

Previously, on the afternoon of November 24, the National Assembly discussed in the hall the draft Law on Road Traffic Order and Safety.

One of the issues that National Assembly deputies are interested in is the proposal to consider regulating an absolute ban on people "driving vehicles while having alcohol in their blood or breath".

Reviewing the issues mentioned by National Assembly deputies, Minister of Public Security To Lam once again affirmed the necessity of promulgating the Law, regarding the name and structure of the draft Law, and reviewing to avoid overlapping in the scope of regulation between the Law on Road Traffic Order and Safety and the Road Law.

It is recommended to continue reviewing the draft Law on Roads and the Law on Road Traffic Order and Safety to avoid overlapping the scope of regulation of the two draft laws or creating legal gaps between the two draft laws, as well as the deadline for synchronizing the implementation of these two laws.

The Minister of Public Security acknowledged the opinions of the National Assembly deputies on adding the vehicles of the Procuracy on emergency missions as priority vehicles; regulations on alcohol concentration of drivers participating in traffic; on journey monitoring devices; regulations on driving licenses; traffic safety for students; control of road traffic safety and order; administrative sanctions; rescue; maintenance of traffic works; measures to prevent people on duty; traffic signals; prevention of traffic jams;

Issuing and changing driving licenses; parking, parking ban; smart traffic equipment; digital conversion; license plate auction; health check of vehicle drivers; age of vehicle drivers participating in traffic; road transport issues; pedestrians...

Dialogue - The 'zero alcohol concentration' regulation is imperative and must be implemented (Figure 2).

Many National Assembly deputies have conflicting opinions about the regulation of "zero alcohol concentration" when driving stipulated in the draft Law on Road Traffic Order and Safety.

Minister To Lam said that the drafting agency will closely coordinate with the National Assembly's Committee on National Defense and Security and relevant agencies to carefully study, absorb, and fully explain to complete the draft law to ensure quality and feasibility.

Regarding this content, at the group discussion session on November 10, Minister of Public Security, General To Lam, said that the law stipulates that driving a vehicle while having alcohol in the blood or breath is one of the prohibited acts, in order to ensure the health of traffic participants, avoid alcohol abuse, protect the race, and limit traffic accidents.

This content is also consistent with the provisions of the Law on Prevention and Control of Harmful Effects of Alcohol and Beer (Clause 6, Article 5 stipulates that driving a vehicle with alcohol concentration in the blood or breath is a prohibited act).

According to the Government's explanation, drivers who drink alcohol will have their ability to judge and handle situations when participating in traffic affected.

In fact, there have been many traffic accidents with serious consequences, killing and injuring many people, caused by drivers violating alcohol concentration regulations .
