Specifically, the document signed by Mr. Ta Nam Chien - Chairman of Ba Dinh District People's Committee sent to Hanoi City People's Committee and Department of Construction stated that the above building was built at 84 Doi Can, with Mr. NHĐ., Mr. NAT, and Ms. VTTN as investors.
According to the Chairman of Ba Dinh District, in February 2021, the People's Committee of Ba Dinh District granted a license to the above 3 individuals to build a project with a scale of 7 floors and 1 basement (excluding the mezzanine and elevator shaft). The height of the project is 24.9m, calculated from the planned pavement level to the roof floor of the 7th floor.
"During the construction process of the investor, the People's Committee of Doi Can Ward and the Urban Construction Order Management Team of the district discovered that the construction was not in accordance with the content of the construction permit No. 47/GPXD-UBND dated February 4, 2021 of the investor.
Specifically, expanding the mezzanine floor area, building on the skylight, not complying with the setbacks on floors 5, 6, 7; expanding the elevator shaft area, on the elevator shaft roof there is a technical area and a cross-roof, increasing the height of the floors," Ba Dinh District People's Committee stated.
According to the People's Committee of Ba Dinh District, the construction work that violated the above-mentioned license content was recorded as an administrative violation by the Doi Can Ward Urban Construction Order Management Team on November 24, 2023.

When the District People's Committee received a report from the People's Committee of Doi Can Ward and the District Urban Construction Order Management Team on the construction that violated the above construction permit content, the Ba Dinh District People's Committee directed the People's Committee of Doi Can Ward and the District Urban Construction Order Management Team to urgently establish a file to handle violations of construction order in accordance with the provisions of Decree No. 16/2022/ND-CP dated January 28, 2022 of the Government on administrative sanctions.
According to the construction permit issued by Mr. Ta Nam Chien - Chairman of Ba Dinh District People's Committee in February 2021, the project is built on a plot of land of 301.3 square meters, divided into two blocks of 4 floors and 7 floors with an attic. Specifically, the 4-storey block located at the front of the project has a construction area of 58.7 square meters, on a plot of land of 68.28 square meters.
In the license, this 4-storey building is located within the area's traffic expansion boundary and has been granted a land use right certificate, allowing construction. The 7-storey building and 1 basement (excluding the mezzanine and elevator shaft) have a first-floor construction area of 191.4m2, on a land plot of 233.02m2.
It is known that the first floor of the 7-storey building has an area of 31 m2 used as a yard, garden, open space, to get light, and there is no roof above.
Ba Dinh District People's Committee said that it is currently in the process of handling the violation. After having specific results of handling the violation, Ba Dinh District People's Committee will report to Hanoi City People's Committee .
