According to Official Dispatch No. 8662/VPCP-KGVX dated November 3, 2023 of the Government Office, considering the proposal of the Ministry of Labor, War Invalids and Social Affairs in Official Dispatch No. 4594/LDTBXH-ATLĐ dated October 27, 2023 on the proposal to take Lunar New Year and National Day holidays in 2024, Prime Minister Pham Minh Chinh agreed with the proposal of the Ministry of Labor, War Invalids and Social Affairs in the above document on taking National Day holidays from August 31, 2024 to September 3, 2024.
The Prime Minister assigned the Minister of Labor, War Invalids and Social Affairs to notify administrative agencies, public service agencies, political organizations, socio-political organizations, enterprises and employees about the National Day holiday in 2024.

Thus, the 2024 National Day holiday lasts 4 days, including 2 National Day holidays and 2 weekly days off.
The Ministry of Labor, Invalids and Social Affairs requests that agencies and units implementing the 2024 National Day holiday schedule pay attention to arranging and reorganizing work units reasonably to handle work continuously, ensuring good service to organizations and people.
Agencies and units that do not have a fixed schedule of Saturday and Sunday holidays every week will base on the specific program and plan of the unit to arrange the National Day holiday schedule in 2024 accordingly.
For employees not belonging to administrative agencies, public service agencies, political organizations, or socio-political organizations, the employer decides to choose the option for the 2024 National Day holiday.
Accordingly, during the National Day holiday, employers choose 1 of 2 days: Sunday (September 1) or Tuesday (September 3).
Employers must notify employees of the 2024 National Day holiday plan at least 30 days before implementation.
If the weekly day off coincides with a public holiday or Tet holiday, the employee will be given a compensatory day off on the next working day.
According to information on Vietnamnet , previously, at the 13th Congress of the Vietnam General Confederation of Labor in December 2023, the General Confederation of Labor proposed that the Party and State add 2 more days off on National Day (from 2 days to 4 days off) so that workers and laborers can take time off from work and take their children to school on the opening day of the new school year on September 5 every year.
According to the Government newspaper, non-state employers proactively choose the option of taking a National Day holiday.

How is overtime pay calculated for holidays and Tet?
According to the provisions of Point a, Clause 2, Article 107 of the 2019 Labor Code and Clause 1, Article 59 of Decree 145/2020/ND-CP, enterprises wishing to employ employees to work overtime on Tet must obtain the consent of the employees (except for some cases where the company is allowed to mobilize employees to work overtime without the consent of the employees as prescribed in Article 108 of the 2019 Labor Code).
Regarding overtime pay, according to Article 98 of the 2019 Labor Code, employees who work overtime during the Lunar New Year during the day will be paid at least 300%, not including holiday pay for employees receiving daily wages (total of 400%).
Overtime pay of employees is exempt from personal income tax.
At the same time, if employees work at night and work overtime at night, they will be paid at least 30% more salary calculated according to the salary unit price + 20% of salary calculated according to the salary unit price or salary according to the work done during the day of a normal working day or of a weekly day off or of a holiday or Tet holiday.
