Concerns about the quality of student transportation services by car

On the morning of November 24, the National Assembly discussed the draft Road Law in the hall. Speaking at the meeting, delegate Thach Phuoc Binh ( Tra Vinh delegation) said that regarding automobile transportation business, the draft law clearly states that automobile transportation business is the implementation of at least one of the main stages of transportation activities, directly operating vehicles, drivers or deciding on transportation fares to transport passengers and goods on the road for profit.

According to Mr. Binh, automobile transportation business is a conditional business type including passenger transportation business and domestic and international freight transportation business by automobile.

Passenger transport business by car includes passenger transport business by bus, passenger transport business by taxi, and passenger transport business under contract.

Corresponding to the types of passenger transport business, the draft specifically describes each business activity, and at the same time assigns the Government to provide specific regulations on automobile transport business.

Delegates assessed that the draft Law has not yet clearly mentioned the type of transportation business by technology vehicles, which is considered a special type of business, in addition to the types of business that have been regulated as in the draft law. Delegates suggested that it is necessary to clearly regulate to create a legal basis for this type of business right in the draft law.

In addition, recent practice shows that the business of transporting students by car has caused many problems in student management and the quality of transportation vehicles.

“To ensure the safety of children, the law should also pay more attention to forms of transportation business related to children and students,” Mr. Binh suggested.

Delegate Nguyen Thi Mai Thoa ( Hai Duong delegation) said that it is necessary to separate the Road Law to focus on regulating issues related to road traffic infrastructure and road transport. The drafting agency has tried to reasonably distinguish the contents under the scope of this law and the Law on Road Traffic Safety and Order.

However, the delegate said that there are still some regulations being stipulated in two laws at the same time, causing inconvenience to people in the process of applying and implementing the law. The delegate suggested that the drafting agency continue to review to ensure that the regulations are not omitted, but also not duplicated, and easy to apply.

Commenting on the activity of transporting students by car, Ms. Thoa said that it is very necessary for the law to have separate regulations to strictly manage the activity of transporting students between their residence and place of study, or participating in other school activities.

“Children are a vulnerable group, and in reality there have been many unfortunate accidents, especially related to picking up and dropping off students,” Ms. Thoa said.

Appreciating the efforts of the drafting agency in regulating this content in both laws without overlapping, however, the delegate said that the most important contents of this activity have been regulated in the Law on Ensuring Road Traffic Safety.

The female delegate suggested that in the draft Road Law, it is only necessary to stipulate that the transportation of students by car is one of the types of passenger transport that must fully comply with general regulations on passenger transport.

According to Ms. Thoa, currently, Article 76 of the draft Law does not stipulate much content, but is still long, mainly regulations related to safety assurance and references to related provisions, in which there are still some unreasonable regulations.

Delegates proposed to add regulations on principles to ensure that road traffic infrastructure at all levels ensures accessibility for people with disabilities .
