Recommendation to review personal responsibility for violations

Previously, the Inspectorate of Kien Giang province issued Inspection Conclusion No. 01/KL-TTr on the topic of planning and implementation of construction planning for the Department of Construction and People's Committees of districts and cities in the area in the period of 2015-2022, thereby discovering a series of violations in the field of construction management.

Shortcomings and violations in project appraisal

The inspection team inspected the compliance with the law in the work of establishing, appraising, approving and adjusting construction planning; construction management according to construction planning; compliance with regulations for approved planning projects... at the Department of Construction and 4 units: Rach Gia city, Kien Luong, An Minh and Go Quao districts.

For the Department of Construction, the results of the inspection of 7 detailed planning projects at a scale of 1/500, discovered that 2 projects had shortcomings and violations such as: The approved detailed construction planning had the size of land plots for building townhouses and individual houses with both sides adjacent to main roads of the area or below exceeding 60m, but did not arrange a walkway with a minimum width of 4m.

In which, there is a detailed construction planning project approved for land plots for social housing construction in some plots of land arranged to exceed 70m2.

The Department of Construction publicly announced the construction planning project later than the prescribed time; did not announce the management regulations for each project; did not advise the Provincial People's Committee to establish and approve the tasks and dossiers for marking the boundary of the construction planning project, which is not in accordance with the provisions of Article 44 of the 2014 Construction Law; Clause 1, Article 9 of Circular No. 10/2016/TT-BXD dated March 15, 2016 of the Ministry of Construction .

Event - Kien Giang: Proposal to review personal responsibility for violations — The inspector pointed out violations by Phu Cuong Kien Giang Joint Stock Company in not paying more than 46 billion VND in land use fees, and when implementing the project, it did not change the land use purpose.

The People's Committee of Rach Gia city and the districts of Kien Luong, An Minh, and Go Quao have publicly announced incomplete planning; have not placed planning boundary markers; and have not developed a plan to implement construction planning, which is not in accordance with regulations.

During the inspection period, the Department of Construction issued 293 construction permits. Through random inspection of 50 construction permit applications, 41/50 cases lacked information on the total number of works and works that had started; 6/50 cases did not have records of on-site inspection of the works; 17/50 cases had floor area adjustments but no documents of appraisal of basic design adjustments from the Department of Construction.

Notably, 34/50 field inspections found that construction works were built without construction permits, but the Department of Construction did not coordinate or handle administrative violations of construction order according to its authority.

This is not in accordance with the provisions of Clause 5, Article 56 of Decree No. 15/2021/ND-CP dated March 3, 2021 of the Government and the regulations on coordination in construction order management issued together with Decision No. 26/23/QD-UBND dated November 13, 2019 of the Provincial People's Committee.

In Rach Gia city and districts: Kien Luong, An Minh, Go Quao, through actual inspection of some constructions, the inspection team discovered some contents such as: construction permit dossiers without records of field inspection of the construction; construction permits not in accordance with planning; construction permits on rural land that has not changed its purpose; permits exceeding construction density compared to standards...

Proposal to review the responsibility of 3 individuals

The Inspectorate of Kien Giang province recommended that the Chairman of the Provincial People's Committee assign the Department of Construction and the People's Committees of Rach Gia city and the districts of Kien Luong, An Minh, and Go Quao to organize a review and seriously draw lessons from the direction and management of the period 2015 - 2022 to prevent the existence of shortcomings and violations.

The Department of Construction and the People's Committees of Kien Luong, Go Quao and An Minh districts have seriously reviewed and drawn lessons from 9 individuals: Director of the Department of Construction; Chairman, former Chairman and Vice Chairman of Kien Luong District People's Committee; Chairman, former Vice Chairman and Vice Chairman of Go Quao District People's Committee; Vice Chairman of An Minh District People's Committee for allowing shortcomings and violations to occur.

Regarding the Department of Home Affairs, the Inspectorate of Kien Giang province recommended advising the Provincial People's Committee to review the responsibilities of three individuals, namely the Chairman of Rach Gia City People's Committee; Chairman and Vice Chairman of An Minh District People's Committee, who let the shortcomings and violations occur during the inspection.
