The Economic Police Department, Ha Nam Provincial Police, announced that it has just initiated a case and prosecuted Bui Van Linh (born in 1987) and Vu Ngoc Tinh (born in 1987), both residing in Truc Ninh District, Nam Dinh Province, for the crime of "Infringement of Industrial Property Rights" occurring in 2022 and 2023, at the Thi Son Industrial Cluster, Thi Son Commune, Kim Bang District (Ha Nam). This is the first case in Ha Nam Province to be prosecuted for the crime of "Infringement of Industrial Property Rights".
Previously, on May 17, 2023, the Economic Police Department of Ha Nam Provincial Police coordinated with the Market Management Department of Ha Nam Province to inspect the compliance with the law in the business activities of goods and services of SOLITI Vietnam Joint Stock Company, located in Thi Son commune, Kim Bang district (Ha Nam), with Bui Van Linh (born in 1987), residing in Truc Ninh district, Nam Dinh province as General Director and Vu Ngoc Tinh (born in 1987), residing in Truc Ninh district, Nam Dinh province as an employee mixing raw materials of the Company.
During the inspection, the working group discovered 1,980 bags of tile adhesive, Super Builder brand, weighing 25kg/bag; 65 Super Builder branded packaging bags with crocodile logos attached, showing signs of infringing industrial property rights.
The working group has drawn up a record of inspection and temporarily detained all of the above goods; at the same time, coordinated with the Institute of Intellectual Property Science - Ministry of Science and Technology to appraise the goods for the tile adhesive, Super Builder brand.
Based on the investigation, verification and appraisal results of the Institute of Intellectual Property Science - Ministry of Science and Technology, on July 27, 2023, the Investigation Police Agency, Ha Nam Provincial Police issued a Decision to prosecute the case and prosecute the accused against Bui Van Linh (born in 1987) and Vu Ngoc Tinh (born in 1987), both residing in Truc Ninh district, Nam Dinh province for the crime of "Infringement of industrial property rights".
At the police station, the two subjects confessed to all their crimes. Accordingly, with the motive of profit, in early 2022, the subject used the Internet to search and learned that the Super Builder crocodile tile adhesive brand was a product brand of a tile adhesive company in Thailand that was popular in the market, so he downloaded the representative brand image of the above company to attach to the product packaging designed by the subject himself with a total of over 108 tons of tile adhesive sold on the market, worth nearly 500 million VND.
Strictly handling subjects of "Infringement of industrial property rights" contributes to creating trust for businesses and investors in the province in particular and the whole country in general to work, produce and do business, develop the economy and society; protect the legitimate rights of consumers.
