Opening the conference, Lawyer Nguyen Van Quyen said that, implementing the 2023 work program, the Party Delegation and the Standing Committee of the Vietnam Lawyers Association organized the 17th joint conference of the Party Delegation and the Standing Committee for the 2019-2024 term. The conference will review and evaluate the results of the Association's activities in the first 9 months of 2023 and set out directions and tasks for the remaining 3 months of 2023; At the same time, listen to the Report on the results of the inspection on the organization and operation of the European Institute of Business and Investment Law (EU Institute).
The role and position of the Vietnam Bar Association are enhanced.
Reporting on the results of activities in the first 9 months of 2023, Lawyer Tran Cong Phan said that the Party Committee, the Standing Committee, the Standing Committee of the Central Association and the leaders of the Lawyers Associations of provinces/cities directly under the Central Government; units and branches directly under the Central Association (hereinafter referred to as the Associations at all levels) always pay attention to, lead and direct the effective implementation of political and ideological work in the entire Association system.
Lawyer Tran Cong Phan, Deputy Secretary of the Party Committee, Vice President and General Secretary of the Vietnam Lawyers Association, reported on the results of activities in the first 9 months of the year and the direction and plan of the Party Committee and the Standing Committee for the last 3 months of 2023.
Regarding the work of participating in policy and law making, the Association has directed specialized units to research and organize comments on draft Laws and Ordinances under the National Assembly's Law and Ordinance making program in 2023. In addition, it has directed the implementation of comments on a number of other legal documents at the request of the drafting agencies.
The Central Committee also organized comments on 16 draft documents and draft dossiers proposing the development of Laws, which received attention and high appreciation from many agencies, units, organizations and individuals.
Local Associations have directly or in coordination with provincial agencies, departments and branches contributed opinions to many important draft legal documents. Thereby, the role and position of the local Lawyers Association has been enhanced in advising, building and perfecting legal policies.
The Central Committee of the Association has researched and collected prolonged complaints and litigation cases to propose to the Vietnam Fatherland Front to conduct supervision according to the Coordination Program No. 02-CTPH/MTTQ-TTCP-BTP-HLG-LDLS dated October 11, 2018.
The Association continues to coordinate with the Ministry of Justice in developing a new Decree to replace Decree 77/2008/ND-CP dated July 16, 2008 on legal consultancy.
The Association has coordinated lawyers from the Legal Consulting Centers under the Central Association to participate and effectively perform legal consulting and legal aid work at the Central Citizen Reception Headquarters and in provinces and cities;
The Bar Associations of provinces and cities; the Legal Advisory Centers under the Central Bar Association; the Legal Advisory Centers under the Bar Associations of provinces and cities continue to provide free or paid legal advice and legal aid to citizens upon request. From the beginning of 2023 to present, the Bar Associations at all levels have provided legal advice on more than 75,000 cases (an increase of 20,000 cases compared to the same period in 2022) and legal aid on more than 31,000 cases (an increase of 2,000 cases compared to the same period in 2022). Participated in consulting and resolving complaints on more than 9,000 cases (a decrease of 2,500 cases compared to the same period in 2022).
Participate in judicial reform, law building and dissemination
In the first 9 months of 2023, the Association Continue to effectively implement the Programs of coordination with ministries, branches and localities, issue and implement the Plan and organize training, improve legal capacity on environmental protection for officials and members of the Bar Association of provinces and cities in the Northern, Southern and Central regions.
In the first 9 months of 2023, the Party Delegation and the Standing Committee of the Vietnam Lawyers Association completed many of the set plans.
The Central Committee of the Association successfully organized a photo exhibition week with the theme "Vietnamese lawyers with the homeland's sea and islands" in Can Tho city from April 17 to April 23, 2023 with thousands of people coming to visit and learn.
In the first 9 months of the year, the association at all levels organized nearly 9,000 propaganda sessions for more than 670,000 people (9 months of 2022 was more than 9,000 sessions) and coordinated with relevant sectors to propagate 30,912 sessions for more than 1,800,000 people (9 months of 2022 was 445,500 sessions).
The Central Party Delegation of the Vietnam Lawyers Association continues to fulfill its role as a member of the Steering Committee and Secretariat of the Central Judicial Reform Steering Committee. continue to implement the direction of the Secretariat on the Project "Building a set of people's assessment indexes for judicial activities" . This project has been assigned by the Secretariat to be piloted in 2024.
In order to carry out the task of developing the Project "Summary and evaluation of the people's defense lawyer institution to find solutions in the coming time" , the Party Delegation has established a Steering Committee, a Project Editorial Team and issued a Plan to implement the Project and ordered research topics according to the content of the Project. According to the plan, the Project will be completed and submitted to the Central Steering Committee for Judicial Reform in December 2023.
At the local level, the Association at all levels actively participates in giving feedback on draft laws and local legal documents, and participates in monitoring delegations of the National Assembly Delegation, People's Council, Fatherland Front, and other interdisciplinary monitoring delegations in the locality when assigned.
Regarding foreign affairs and international cooperation, the Vietnam Lawyers Association has coordinated to organize a national moot court competition for law students; completed procedures to request permission and prepare to organize the Conference of the Executive Board of the Association of Lawyers of Asia and the Pacific (COLAP) in Vietnam scheduled for December 2023 and organized a delegation to survey and learn from the experiences of agencies and organizations operating in a number of countries.
Organizational work, cadres and members have also been focused on. The Party Committee of the Vietnam Lawyers Association has organized working delegations to work with Party committees and authorities of some localities. Through the working sessions, the provincial/municipal Party Committees have recognized, evaluated and promoted the role of local Associations at all levels in the new period; at the same time, they will continue to pay attention, lead, direct and create favorable conditions for Associations at all levels to continue to develop in terms of organization and operate more and more effectively and efficiently, contributing to socio-economic development and ensuring national security and defense in the locality.
Regarding information, propaganda, press, publishing and scientific research work, the Party Central Committee and the Standing Committee of the Central Association have promptly directed and guided press and publishing agencies and the Central Association's General Information Portal to perform well their assigned tasks, actively participating in propagating the Party's guidelines and viewpoints, the State's policies and laws; and the country's socio-economic development policies to cadres, members and the people. In particular, it is important to focus on propagating the Party and State's guiding documents on the work of the Vietnam Lawyers Association such as Directive No. 14-CT/TW dated July 1, 2022 of the Politburo on continuing to strengthen the Party's leadership over the Vietnam Lawyers Association in the new situation.
In the first 9 months of the year, the President of the Vietnam Lawyers Association also decided to award the Medal "For the development of the Vietnam Lawyers Association" to 413 individuals of the Lawyers Associations of provinces, cities, units and branches under the Central Association who have made many contributions to the cause of building and developing the Vietnam Lawyers Association. The association unanimously awarded the Government's Emulation Flag to the Hai Duong Provincial Lawyers Association, and the association unanimously awarded the Prime Minister's Certificate of Merit to the Hoa Binh Provincial Lawyers Association at the proposal of the Central Emulation and Commendation Committee.
The Central Committee of the Vietnam Lawyers Association also prepares related work, sends documents to concerned provincial/municipal Party Committees, coordinates and directs, creates conditions for the Associations at all levels to prepare and organize the Congress according to the set plan, towards the 14th National Congress of the Vietnam Lawyers Association, term 2024 - 2029; guides the Associations at all levels to prepare a Report on the implementation of the Association's Charter in 2020.
Many tasks to be done in the last 3 months of 2023
According to the report on the first 9 months of operation in 2023, the Central Committee of the Vietnam Lawyers Association has also received the leadership and direction of the Party Committee, the Standing Committee, the Standing Committee and from the practical requirements of implementing the political tasks of the Association and of localities, units, and branches of Lawyers Associations under the Central Committee of the Association and Lawyers Associations of provinces and cities, has developed and issued many specific programs and action plans. The study, dissemination and implementation of the Party's guidelines and viewpoints, the State's policies and laws; studying and following Ho Chi Minh's ideology, morality and lifestyle continue to be promoted. The ideology of cadres and members is stable, always having absolute trust in the leadership of the Party, the management of the State, actively participating in building local governments, contributing to political stability, economic development and maintaining social order and safety, enthusiastically competing to successfully complete assigned tasks.
In the last 3 months of 2023, the Party Delegation and the Standing Committee of the Vietnam Lawyers Association will continue to complete unfinished tasks and plans and implement many new plans.
In the last 3 months of the year, the Vietnam Lawyers Association continued to thoroughly grasp and effectively implement the directions of the Party and the State, especially the Resolution of the 13th National Congress of the Party and documents on the work of the Vietnam Lawyers Association. The focus is on studying, thoroughly grasping and implementing Decision No. 118-QD/TW, dated August 22, 2023 of the Secretariat on promulgating the regulations on organization and operation of mass associations assigned by the Party and the State at the Central level. At the same time, continue to promote studying and following the ideology, morality and lifestyle of Ho Chi Minh.
Implementing Action Program No. 163/Ctr-HLGVN dated May 30, 2023 on implementing Directive No. 14-CT/TW dated July 1, 2022 of the Politburo on continuing to strengthen the Party's leadership over the Vietnam Lawyers Association in the new situation.
Continue to participate in policy and law development, focus on research and comment on draft laws, especially the Land Law (amended), the Commercial Arbitration Law (amended), and the Social Insurance Law (amended). Actively and effectively participate in drafting committees and editorial teams of draft laws and programs and projects of the Government and ministries, departments and branches at the central level; implement the tasks of the plan to develop a dossier to propose the development of the Commercial Arbitration Law (amended) to report to the National Assembly Standing Committee and competent authorities for timely addition to the National Assembly's Law and Ordinance Development Program for 2024.
Continue to research and develop the Project "Promoting the role of Lawyers' Associations at all levels in disseminating and educating the law in the period of 2023-2030" to submit to the Prime Minister for approval after the Prime Minister agrees in principle.
Coordinate with the Central Internal Affairs Commission and the Central Propaganda Commission to develop a pilot plan for the Project "Building a set of people's assessment indexes for judicial activities" in 2024 under the direction of the Central Party Secretariat.
Develop the Project "Summary and evaluation of the people's defense attorney system to find solutions in the coming time" as required by the Central Steering Committee for Judicial Reform.
Prepare documents and implement procedures for appraisal, approval and acceptance of the Project "Improving capacity for dissemination and legal consultancy in the field of land" phase 2.
Proactively implement Instruction No. 188/HD-BCĐ of the Central Committee of the Vietnam Lawyers Association on organizing Congresses of Lawyers at all levels.
Continue to promote the role of press and publishing units under the Central Association in informing and propagating the Party's guidelines and policies, the State's laws and promoting the Association, promptly updating information on the activities of the Association at all levels from central to local.

Lawyer Le Minh Tam, member of the Standing Committee of the Vietnam Lawyers Association, said that to avoid risks in personnel management, it is recommended to monitor and check the background of members or personnel under the association.
Lawyer Nguyen Van Du, member of the Party Committee, Vice President of the Vietnam Lawyers Association, Deputy Chief Justice of the Supreme People's Court, said: Mediation work is mainly carried out by members of the Association, the Court is only the place to recognize the success or failure of the mediation. Therefore, the results of mediation and participation in mediation also need to be included in the report on the results of activities in the first 9 months of 2023.
Lawyer Le Xuan Than, member of the Standing Committee of the Central Committee of the Vietnam Lawyers Association, Chairman of the Khanh Hoa Provincial Lawyers Association, and a National Assembly delegate of the 15th tenure, said that it is necessary to soon complete comments on the amendments to the Commercial Law, with the roadmap being to submit the law to the National Assembly for discussion in mid-2024 and pass it by the end of 2024. At the same time, comments on draft amendments to other laws should be made to bring the law closer to real life.
