On June 21, with 457/463 delegates present in favor (accounting for 93.84%), the National Assembly passed the Law on Archives (amended). The law stipulates that January 3 of each year is Vietnam Archives Day.

Regarding the value of archival documents, the Law stipulates that archival documents are evidence of the activities of the Party, State, society, agencies, organizations, individuals, families, clans, and communities through historical periods of Vietnam.

Archival documents have historical value, legal value and practical value in all areas of social life.

Digital archives have full legal value as data messages according to the provisions of law on electronic transactions.

National Assembly deputies voted to pass the Law on Archives (amended).

In Article 8 on “Prohibited acts”, the Law prohibits: Illegally transferring, providing, destroying or intentionally damaging, buying, selling, appropriating, or losing archival documents managed by competent agencies of the Party and State.

Falsifying, distorting the content, destroying the integrity of archival documents and master data of archival documents; illegally accessing, copying, sharing archival documents and archival document databases.

Illegally destroying private archives of special value. Using archives or taking advantage of archival services to infringe upon national and ethnic interests, public interests, and the legitimate rights and interests of agencies, organizations, individuals, families, clans, and communities; obstructing the right of agencies, organizations, and individuals to access and legally use archives. Taking archives abroad, out of current archives, or into historical archives in violation of the law.

In addition, in Article 53 on "Archive service activities", the Law stipulates: "1. Archival service activities include: Trading in technical infrastructure to preserve paper records, archival documents, documents stored on other information carriers; trading in technical infrastructure to store digital records, archival documents and archival document databases; digitizing, creating, and standardizing archival document databases; repairing, disinfecting, deacidifying, and cleaning documents and document archives; consulting on archival operations.

2. The storage service business activities specified in Clause 1 of this Article belong to the conditional investment and business sectors and professions...”.

Previously, explaining, accepting and revising the draft Law on Archives (amended), Mr. Hoang Thanh Tung - Chairman of the National Assembly's Law Committee said that there were opinions suggesting considering not regulating archival service activities as conditional investment and business sectors, because these activities do not affect the interests of the community.

Regarding this issue, the Standing Committee of the National Assembly believes that archival services are specialized and professional activities, related to archival documents with permanent preservation value, which are historical documents of the country, containing a lot of important information about the activities of agencies, organizations and individuals, including information whose access can affect national security, social order and safety, so it needs to be strictly managed.

Furthermore, this is not a new regulation but inherits the 2011 Law on Archives, which stipulates that organizations and individuals providing archive services must meet certain conditions, which are essentially investment and business conditions. Therefore, it is appropriate to stipulate that archive services are a conditional investment and business sector.

In addition, there are opinions suggesting that the criteria for archival documents of special value should not be specified in the draft Law (Article 38) but should be specified in sub-law documents so that they can be flexibly adjusted when necessary.

Regarding this issue, Mr. Tung said that the National Assembly Standing Committee believes that the 2011 Law on Archives has stipulated criteria for precious and rare archival documents.

The criteria for determining archival documents of special value stipulated in the draft Law are built on the basis of inheriting and perfecting the provisions on precious and rare archival documents of the 2011 Law on Archives. Therefore, we would like to ask the National Assembly to keep this provision to ensure the specificity of the Law and limit the issuance of detailed regulations .
