Recently, the Inspectorate of Hoa Binh province issued Inspection Conclusion No. 27/KL-TTr concluding the compliance with legal regulations on land, finance, and construction to implement projects for which the State allocated land, leased land, and recognized land use rights for organizations and enterprises in Mai Chau district in the period 2011 - 2021.
During the inspection, the Hoa Binh Provincial Inspectorate discovered many enterprises with violations in the fields of land and construction, specifically:
The Mai Chau Ecologdge Ecotourism Resort Project (invested by Mai Chau Ecotourism Resort Company Limited) was permitted by the People's Committee of Hoa Binh province to convert the purpose of using 17,395.5 m2 of production forest land to non-agricultural production and business land. However, the investor could not provide documents and records related to determining the forest area on production forest land and the dossier of reforestation.
In addition, this unit could not provide planning documents and construction permits while in reality it had: built 19 motels with a total construction area of 2,940 m2 ; a reception house and restaurant with an area of 225 m2 ; a conference house and staff housing with an area of 93.1 m2 ; a tour guide's housing with an area of 100 m2 ; a swimming pool with an area of 249.9 m2 ; and an internal yard and garden.
The investor of the Bamboo Panel Factory Project, BWG Mai Chau Joint Stock Company, has failed to provide construction design appraisal documents or construction permits for construction works on the project's land.
The Hop Thuy commercial service complex project (invested by Hop Thuy Commercial Service Company Limited) has completed the construction investment and put into operation, but the investor has constructed the project not in accordance with the construction permit and the approved master plan. Specifically, the garden and parking lot items were licensed for 624 m2 , but the actual construction area was 444.61 m2 . Therefore, the project violated the parking lot area and construction density.
The above violation was punished by the Inspectorate of the Department of Construction of Hoa Binh province in Decision No. 90/QD-XPHC dated July 1, 2020, fining Hop Thuy Trading Service Company Limited 40 million VND. The unit has paid the above amount into the account of the Department of Construction of Hoa Binh province but has not yet implemented the content at Point c, Clause 6, Article 1 of Decision No. 90/QD-XPHC that within 60 days, the company must complete the procedure to request the competent authority to grant a construction permit to adjust the project.
The works in phase 1 of AVANA Mai Chau Resort Project (invested by AVANA Mai Chau Company Limited) have been completed and put into operation, but through inspection, the Inspectorate of Hoa Binh province discovered that the construction was not in accordance with the construction permit issued by the Department of Construction of Hoa Binh province, specifically as follows: 2-storey administrative building; bar, swimming pool; 1-storey restaurant; 1-storey swimming pool villa; 1-storey luxury motel; 1-storey motel; courtyard house in the spa area; spa huts No. 1,2; health consultation room, 1-storey house; construction lacking 01 wastewater treatment station...
AVANA Mai Chau Company explained to the authorities that, during the construction process of the items, due to the complex terrain, the unit had to adjust some items to suit the functions and needs of customers to ensure the unit's business efficiency and fulfill its financial obligations to the state.
Regarding the Mai Chau Commercial Service Complex Project (Sub-area 2, Mai Chau town, Mai Chau district), the investor, Mai Chau Trading One Member Co., Ltd., is leveling the land on the project land area and pouring concrete floors on the surface of Suoi Van without a construction permit. On March 15, 2022, the investor was issued a decision by the Road Administration Department 1 to impose an administrative penalty in the field of road traffic with an amount of 4 million VND. The reason for the penalty is that it has lost the drainage function of the road project. The unit has paid the above amount but has not yet taken remedial measures to restore the original state caused by the administrative violation.
Mai Chau District People's Committee also granted construction permits without proper authority as prescribed in Article 8, Decision No. 20/2020/QD-UBND dated November 13, 2020 on promulgating regulations on construction permit management in Hoa Binh province for the Ngoc Bach Conference Center Project (invested by Ngoc Bach One Member Co., Ltd.).
At the Project of Growing and Preliminary Processing of Clean Medicinal Herbs in the direction of commodity production (Thung Khe Commune, Mai Chau District), the investor, Thung Khe Agricultural Tourism Joint Stock Company, is using a level 4 worker house, about 30 m2 in area, with brick walls, marble floors, and corrugated iron roof (due to the transfer of assets on land from Lan Tran Environmental Technology Application and Investment Company Limited, now Mai Chau Construction Joint Stock Company) but has not been granted a construction permit by the competent authority.
The Inspectorate of Hoa Binh province requested relevant agencies such as the Department of Natural Resources and Environment, Department of Construction, Department of Agriculture and Rural Development, etc. to coordinate, inspect, review and thoroughly handle the above violations.
