Favorable legal corridor for inspection activities to be gradually professional and effective

The 2022 Inspection Law with many new points has been creating a legal corridor for transparent, gradually professional and effective inspection activities.

Dak Lak Newspaper reporter had an interview with Deputy Chief Inspector of the province PHAM VAN SAU about this content.

* From July 1, 2023, the 2022 Inspection Law officially replaces the 2010 Inspection Law. Can you share the new points of the 2022 Inspection Law?

The 2022 Law on Inspection has many new points in affirming the responsibility of heads of state management agencies in inspection work; organization of inspection agencies; inspection activities; handling overlaps and duplications; appraisal and conclusion of inspections...

Notably, regarding inspection activities, the 2022 Inspection Law eliminates the form of regular inspection, and only stipulates two forms of inspection, including planned inspection and surprise inspection.

The Law supplements regulations on appraisal of draft inspection conclusions before issuing conclusions; an inspection may issue multiple inspection conclusions and reports requesting opinions from the person making the inspection decision to the head of the state management agency at the same level on important and complicated issues before issuing inspection conclusions. Before publicizing the inspection conclusion, the person making the inspection decision may amend and supplement the issued inspection conclusion to ensure accuracy, objectivity and feasibility.

According to the 2010 Law on Inspection, inspected subjects have the right to appeal inspection conclusions. However, the new Law stipulates that inspected subjects only have the right to make recommendations about the content of the inspection conclusion if they believe that the content is inaccurate.

In handling overlapping and duplication of inspection activities, the new Law stipulates that each Ministry has only one general inspection plan; each province has only one inspection plan. The Law also provides more specific regulations on handling overlaps in the process of conducting inspection activities between inspection agencies; between inspection activities and state audit activities.

Another notable new point is that some regulations previously stipulated in sub-law documents have now been included in the 2022 Law on Inspection, such as: regulations on inspectors, persons assigned to perform specialized inspection tasks; regulations on the order and procedures for conducting an inspection; regulations on supervision of inspection activities; authority, process, and deadlines for reporting inspection results, developing, issuing, and publicizing inspection conclusions...

* According to you, what new points of the Law have contributed to overcoming difficulties and problems in the process of implementing inspection work in the province?

In reality, the implementation of the 2010 Inspection Law has encountered difficulties and obstacles that have reduced the effectiveness of inspection work. Therefore, the development and promulgation of the new Inspection Law not only proves its necessity, but also makes an important contribution to overcoming existing shortcomings and inadequacies.

The 2022 Inspection Law abolishes the form of regular inspection to increase professionalism in inspection activities, while distinguishing between inspection and examination. An inspection can issue many inspection conclusions, because an inspection has many contents, so the contents that are clear and have sufficient basis will be concluded immediately to serve state management work, making inspection activities flexible and closely linked to management activities. At the same time, it overcomes the situation of slow issuance of inspection conclusions for the entire inspection.

The regulation that the provincial level has only one provincial inspection plan issued by the Chairman of the Provincial People's Committee will contribute to overcoming the overlapping and duplication in the development and implementation of annual inspection plans among state inspection agencies in the province; minimizing the impact on the normal operations of the inspected subjects. At the same time, it aims to strengthen the role and responsibility of the Provincial Inspectorate in directing, inspecting, and urging the implementation of the annual inspection plan and providing professional guidance to subordinate inspectors to achieve efficiency in inspection activities throughout the Dak Lak sector.

Not only that, some regulations previously stipulated in sub-law documents have now been legalized to create consistency in implementation; conducting inspections quickly, overcoming the situation of prolonged inspection time, slow reporting of inspection results, slow issuance of inspection conclusions, and enhancing the responsibility of those conducting inspections. At the same time, it aims to proactively prevent corruption and negativity, and improve discipline and order for those conducting inspections.

* Sir, to put the Law into practice, how is the promotion of the Law being implemented?

Right from the beginning of the year, the Provincial Inspectorate issued a plan on disseminating legal education in 2023, including the Law on Inspection in the province.

To implement this plan, up to now, the Provincial Inspectorate has organized two conferences to disseminate and disseminate the 2022 Inspection Law to district and commune-level officials and civil servants in Cu M'gar and Lak districts. The Provincial Inspectorate has also coordinated with the Department of Health Inspectorate and Cu Kuin District Inspectorate to organize three conferences to disseminate and disseminate the Law to officials, civil servants and public employees. The activities attracted thousands of participants.

In addition, immediately after the 2022 Law on Inspection took effect, the Provincial Inspectorate organized a conference to disseminate and thoroughly grasp the Law, Decree 43 of the Government detailing a number of articles and measures to implement the Law for all civil servants of the Provincial Inspectorate; directed inspectors of departments, districts, towns and cities to study and master the new regulations for implementation.
