The People's Committee of Hanoi City has recently issued Regulations on a number of contents related to the land sector in Hanoi City.

The Decision will take effect from October 7, 2024, applicable to state agencies, land users under the Land Law and relevant parties in land management and use in the area.

Accordingly, the document announces new regulations on conditions and minimum areas for land division and land consolidation, implementing Clause 4, Article 220 of the Land Law.

Specifically, the division of residential land plots must ensure the principles and conditions prescribed in Article 220 of the Land Law and some additional conditions.

In wards and towns, the land plot has a length (depth) from the red line boundary of 4m or more, the width of the side adjacent to the existing public traffic road or the path formed when dividing the plot is from 4m or more, the land area outside the red line boundary is not less than 50m2.

For communes in the plains, the minimum area is not less than 80m2, for communes in the midlands, the minimum area is not less than 100m2 and for communes in the mountainous areas, the land area is not less than 150m2.

For non-agricultural land (not residential land), in wards and towns, commercial service land after subdivision must have a minimum area of ​​not less than 400m2, non-agricultural land (not commercial service) must have a minimum area of ​​not less than 800m2.

In the remaining communes, commercial service land after subdivision must have a minimum area of ​​not less than 1,000 m2, non-agricultural land (not commercial service) must have a minimum area of ​​not less than 2,000 m2 in the communes.

As for agricultural land, the minimum area for land for annual crops is 300m2 in wards and towns and 500m2 in communes; land for perennial crops and aquaculture are 500m2 in wards and towns and 1,000m2 in communes, respectively. Production forest land is divided into plots if the area is not less than 5,000m2.

If the land user wants to reserve a part for a walkway, the land plot must ensure that the walkway has a cross-sectional width of 3.5m or more in wards and towns and 4m or more in communes.

Previously, many provinces and cities such as Thanh Hoa, Bac Giang... also issued regulations on land division, with the minimum area for urban land to be divided from 30 to 35 square meters.

Thus, in Hanoi alone, the regulations on land division are much higher than the old regulations and compared to other provinces and cities.
