On May 8, Deputy Prime Minister Tran Hong Ha chaired an online conference with 63 provinces and cities nationwide on the development of a Decree regulating compensation, support, and resettlement when the State acquires land and a Decree regulating land prices.
Comrade Nguyen Cao Son, Provincial Party Committee member, Vice Chairman of the Provincial People's Committee chaired at the Ninh Binh province bridge. Also attending were leaders of a number of departments, branches, districts and cities.
After the National Assembly passed the 2024 Land Law with 16 chapters and 260 articles (2024 Land Law), on March 5, 2024, the Prime Minister issued Decision No. 222/QD-TTg promulgating the Plan to implement the Land Law No. 31/2024/QH15. The Prime Minister assigned the Ministry of Natural Resources and Environment to preside over the development of a Decree regulating compensation, support, and resettlement when the State reclaims land.
Therefore, it is extremely necessary to issue a Decree regulating compensation, support, and resettlement when the State acquires land to provide detailed guidance on the implementation of a number of articles of the 2024 Land Law and the Decree regulating land prices.
Based on the appraisal opinions of the Ministry of Justice and comments from ministries, branches, localities and organizations, the Ministry of Natural Resources and Environment has completed the draft Decrees.
The draft Decree regulating compensation, support and resettlement when the State recovers land is built with 3 chapters, 36 articles with many important contents such as: General regulations on compensation, support and resettlement plans when the State recovers land; compensation by land with a different purpose than the recovered land or by housing when the State recovers land; compensation, support and resettlement when the State recovers land for investment projects applying special policies; detailed regulations on compensation for residential land, other land in land plots with houses, houses and works serving life, agricultural land, non-agricultural land; budget arrangement and payment of compensation, support and resettlement, etc.
The draft Decree regulating land prices is composed of 6 chapters and 44 articles, stipulating many contents such as: procedures and contents of determining land prices by comparison method, income, surplus and land price adjustment coefficient; factors affecting land prices; general regulations in developing land price lists, regulations on land price lists according to land location and land price lists for each land plot based on value zones and standard land plots; regulations on land price list appraisal; conditions for individuals practicing land price determination consultancy and requirements and conditions for training and fostering facilities for knowledge on land valuation...
At the conference, delegates from ministries, branches, localities, experts and scientists basically agreed with the Draft Decrees developed by the Ministry of Natural Resources and Environment and directly commented on the articles and clauses to complete the Draft, focusing on the following contents: subjects receiving support for stabilizing their lives, training, career conversion and job search; other cases receiving compensation for land and conditions for receiving compensation for land; costs to ensure the organization of compensation, support and resettlement; regulations on land price lists according to land location; methods for determining average annual net income, methods for determining the value and land price of land plots to be appraised; methods for calculating investors' profits when applying the surplus method; land valuation methods for transitional cases; procedures and contents for developing land price lists...
Concluding the conference, Deputy Prime Minister Tran Hong Ha highly appreciated the Ministry of Natural Resources and Environment, central ministries, branches, localities, experts and associations for actively researching and contributing ideas to gradually perfect the development of the Decree regulating compensation, support and resettlement when the State recovers land and the Decree regulating land prices.
Affirming that these are important documents contributing to the early and effective implementation of the 2024 Land Law in life.
The Deputy Prime Minister requested the Ministry of Natural Resources and Environment to coordinate with experts, associations, ministries and sectors to unify theoretical basis, practice, methods, and develop decrees to ensure conformity, synchronization and unity between land law and other relevant legal regulations; ensuring inheritance, stability and development.
Localities continue to research and send comments to develop decrees, amend and supplement regulations that are not suitable to reality, creating unity, objectivity, fairness, ensuring harmonious rights and interests for businesses and affected people.
