Do teachers who teach online have to register? Will they be punished if they 'devote themselves to teaching students at home for free'? These are questions many teachers have when implementing Circular 29 on extra teaching and learning.

In recent days, in the process of implementing regulations on extra teaching and learning, some teachers have raised questions about the organization and participation in extra teaching and learning inside and outside of school.

Teaching in person or online is considered extra teaching.

For example, a teacher raised the question: ''I am teaching at a specialized high school, but because of my passion for the excellent student team, I want to provide free tutoring for students at home. Is that possible? If the inspection team discovers that I am tutoring at home, will I be punished? How can I prove that I am tutoring for free? If I tutor online, do I have to register?''...

In response to the above questions, Mr. Ho Tan Minh, Chief of Office of the Department of Education and Training of Ho Chi Minh City, answered in Circular 29 that extra teaching and learning only has the concept of extra teaching and learning inside and outside of school. Direct teaching or online teaching is the method chosen by teachers and students. Therefore, whether teaching inside or outside of school, it must comply with regulations, whether free or for a fee. Whether teaching directly or online, it is considered extra teaching and must comply with regulations.

Ho Chi Minh City Department of Education and Training does not prohibit extra teaching and learning, but must comply with regulations.

According to Article 4, Circular 29, teachers who are teaching at schools can participate in extra classes outside of school but are not allowed to teach extra classes for money to students who are currently teaching at school. In addition, teachers at public schools are not allowed to organize businesses.

Therefore, teachers are only allowed to teach at licensed facilities and are not allowed to manage or organize extra teaching and learning outside of school. In addition, whether teaching directly or online, teachers are not allowed to organize extra teaching for primary school students, except in cases of training in arts, sports, and life skills.

Nurture excellent students according to school assignment

Regarding the situation mentioned above by the specialized school teacher, Mr. Minh said that student training is part of the school's educational plan and the schools have arrangements to assign teachers to participate in this work.

Therefore, when there is a desire or personal plan related to teaching and training excellent students, teachers should propose to the school to arrange appropriate training work, in accordance with regulations, to avoid "circumventing" circulars leading to incorrect implementation of regulations on extra teaching and learning.

If teachers do not comply with regulations, they will be held legally responsible for their activities.

Article 14 of Circular 29 clearly stipulates the responsibilities of teachers when participating in extra teaching activities as follows:

  • Implement the regulations on extra teaching and learning in this circular and other relevant legal regulations.
  • Manage and ensure the quality of extra teaching and learning and the rights of students and tutors; manage and use extra-learning money according to regulations.
  • Manage and keep records of extra teaching and learning organizations according to regulations.
  • Report and explain the implementation of the provisions of this Circular and relevant legal provisions to competent authorities when requested.
  • Receive and handle opinions, recommendations and wishes of students and parents about extra teaching and learning before and during the implementation process.

The circular also increases the principal's management responsibility for teachers who participate in extra-curricular teaching outside of school. Specifically, teachers who teach extra-curricular teaching outside of school must report to the principal about the subject, location, form, and time of extra-curricular teaching.
