Supervise the implementation of policies and laws at the Department of Agriculture and Rural Development

BTO-On the afternoon of August 9, the Provincial National Assembly Delegation's supervision delegation led by Mr. Nguyen Huu Thong - Provincial Party Committee member, Deputy Head of the Provincial National Assembly Delegation, supervised the implementation of legal policies on the promulgation of legal documents from January 1, 2019 to June 30, 2023 at the Department of Agriculture and Rural Development.

According to the report of the Department of Agriculture and Rural Development, in the past time, the Department has advised the Provincial People's Committee and People's Council to issue documents in accordance with the correct order and procedures; content in accordance with legal regulations; feasibility, suitable for the subjects of regulation. The documents were issued to promptly institutionalize the Party's policies and resolutions and to concretize the assigned tasks. In addition, the Department has fully guided the legal documents issued by competent agencies, related to activities under specialized management; New points, regulations that need attention to serve the work of building and issuing legal documents. The Department's leaders have directed the specialized departments and branches under the Department to advise the Department to register the Provincial People's Committee to submit to the Provincial People's Council to issue Resolutions or submit to the Provincial People's Committee to issue decisions.

At the meeting, members of the monitoring delegation discussed and pointed out some shortcomings: the advisory work on issuing documents is sometimes not timely, such as Resolution 02 on supporting funding for installing fishing vessel monitoring equipment (VMS). This policy is implemented slowly compared to the wishes and recommendations of fishermen. Or the Resolution on bird nest farming areas, areas where breeding is not allowed, as well as the policy to support the relocation of bird nest farming households, the advisory work is also slow and prolonged, affecting people's lives. In addition, the quality of drafted documents is not guaranteed, partly because civil servants advising on the drafting and reviewing of legal documents mostly work part-time, so they have not really been effective in helping the Head review and systematize documents in the assigned state management fields... In addition, the representative of the Department of Justice also pointed out that after reviewing, it was discovered that more than 10 documents submitted by the Department of Agriculture were no longer suitable and had expired...

Concluding the monitoring session, Mr. Nguyen Huu Thong assessed that in the past time, the Department of Agriculture and Rural Development has basically advised the Provincial People's Committee and the Provincial People's Council on many documents in the field of the sector to be in line with reality, in accordance with policies as well as meeting the expectations of many subjects such as farmers, fishermen... contributing to the economic and social development of the province.

However, the biggest limitation currently facing not only the agricultural sector is the lack of human and material resources for institutional development. Currently, no agency in the country has its own legal department. Therefore, the quality of consulting and issuing documents related to legal norms is still poor, with limited and incomplete language and semantics. Over 10 documents that the Department consulted have expired, but the Department of Agriculture and Rural Development has not reviewed them. Therefore, the Deputy Head of the Provincial Delegation of National Assembly Deputies requested the Department to review outdated and inappropriate documents for abolition.

Regarding the two resolutions, the Department of Staff did not provide timely advice, which unintentionally reduced the quality of the resolutions when they were issued, causing people to lose interest and distrust in state agencies. Therefore, Mr. Thong requested that the Department of Agriculture and Rural Development should pay attention when ministries and central branches request comments on draft laws, and be more proactive in consulting and coordination work. Regarding the contents that members of the monitoring delegation commented on, the Department of Agriculture and Rural Development should promptly complete the report, specifying the difficulties, problems as well as related recommendations for the monitoring delegation to synthesize and have a general report on law enforcement, and submit to ministries, branches and the National Assembly in the coming time.
