At the regular Government Press Conference in January 2024 (afternoon of February 1), reporters from the Journalists and Public Opinion newspaper sent questions to the leaders of the Ministry of Natural Resources and Environment regarding the draft Land Law (amended) recently passed by the National Assembly and the amendment of Decree 44 regulating land prices.

Specifically: The Land Law (amended) has just been passed by the National Assembly and will officially take effect in January 2025. Please let us know the solutions to ensure smooth implementation and the plans and programs to develop sub-law documents to ensure that the law can be implemented immediately after it takes effect. Please let us know when Decree 44 related to land prices will be revised?

It is expected that there will be 9 decrees detailing the implementation of the amended Land Law, Article 1.

According to Deputy Minister Le Minh Ngan, the Ministry of Natural Resources and Environment has prepared to implement the Land Law (amended) as soon as possible.

Responding to the question, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that on January 18, 2024, the National Assembly officially passed the amended Land Law. In the process of preparing for the amended Land Law, the Ministry of Natural Resources and Environment has prepared to implement the Law as soon as possible to bring it into life.

"First of all, we have provided new contents and new points of the 2024 Land Law to agencies and the media to have materials for propaganda. Second, the Ministry has proactively reviewed and developed a plan to submit to the Prime Minister to issue a plan to implement the 2024 Land Law," said Mr. Ngan.

Specifically, Deputy Minister Le Minh Ngan said, regarding the organization of the development of detailed documents guiding the implementation of the Land Law: The Land Law (amended) has stipulated the contents under the authority of the Government, the Prime Minister, the Minister, the Provincial People's Council and the Provincial People's Committee.

Accordingly, the plan has carefully reviewed the points and provisions in the Law that the Government is assigned to issue detailed regulations. "We plan to have 9 Decrees. Of which, the Ministry of Natural Resources and Environment will directly advise the Government to issue 6 Decrees, the Ministry of Finance will advise on issuing 2 Decrees and the Ministry of Agriculture and Rural Development 1 Decree. It is expected to issue 6 Circulars, of which the Ministry of Natural Resources and Environment will have 4 Circulars, the Ministry of Finance will have 1 Circular and the Ministry of Home Affairs will have 1 Circular", Deputy Minister Le Minh Ngan informed.

According to Mr. Le Minh Ngan, there is a Decision of the Prime Minister that the Ministry of Labor, War Invalids and Social Affairs will advise. For local authorities, there are 18 contents under the authority of the Provincial People's Committee to specify in detail, and 1 content under the authority of the People's Council to issue. The plan has been stated very clearly, distinguished very clearly and has provisions for preparation time.

"Along with the issuance of documents guiding the implementation of the Law, the assignment of tasks to ministries, branches and localities to review current legal documents to ensure consistency and consistency with the Land Law (amended), including laws related to land that we have not been able to directly amend with the Land Law during the process of amending the Land Law, will continue to be reviewed to ensure consistency," Mr. Ngan stated.

According to Deputy Minister Le Minh Ngan, the Ministry of Natural Resources and Environment has developed a plan to disseminate, propagate, and guide the implementation of the Land Law (amended).

Second, regarding decrees related to land management, the Deputy Minister of Natural Resources and Environment said that relevant ministries and branches will continue to review. Localities will also continue to review regulations and legal documents under their authority to amend, supplement, and promulgate to ensure consistency and uniformity.

Regarding the third content, which is to prepare for the organization of dissemination of the basic contents of the Land Law and documents guiding its implementation, according to Deputy Minister Le Minh Ngan, the Ministry of Natural Resources and Environment has developed a plan to disseminate, propagate, and guide the implementation of the Law, coordinating with central agencies, ministries, branches, and news and media agencies to disseminate to subjects actually affected by the Law. How to make the new points of the Land Law, the contents of the Land Law and documents guiding its implementation known to subjects affected by the Law and all people, and the management and implementation process of state management agencies as well as people and businesses be most favorable, ensuring feasibility.

Regarding the fourth content, the Ministry of Natural Resources and Environment has a plan to deploy solutions and resources to implement the Land Law. Accordingly, the Ministry of Natural Resources and Environment will propose to the Government to focus resources on implementing state management contents such as: Building a land database, conducting basic land assessment surveys, maintaining the land information system. For localities, resources will also be focused, first of all on land development funds, ensuring the creation of land funds to carry out land use assessment organizations, build infrastructure for resettlement areas, etc.

At the same time, localities organize the construction of local land databases, connecting with the central land database, ensuring consistency, synchronization, and connection with other national databases. Ensure that the Land Law with its implementing guidelines, as well as new policies are implemented synchronously after the Law comes into effect.

Regarding the amendment of Decree 44, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the amendment was directed by the Prime Minister very early. However, this is a very important Decree, having a great impact on land finance and land prices. Therefore, in the recent past, the Government has directed ministries and branches at the central level, especially the Ministry of Natural Resources and Environment, the Ministry of Finance and localities to hold many workshops to collect opinions to select the best and most optimal options to ensure the objectives and requirements of the Decree, while being consistent with the spirit of the 2024 Land Law.

Recently, all procedures for issuing the Decree have been completed. Up to now, Deputy Prime Minister Tran Hong Ha has directed and agreed that the Ministry of Natural Resources and Environment will coordinate with the Government Office to complete the final stages to issue the Decree as soon as possible and put it into practice.
