The draft Land Law (amended) is being discussed enthusiastically by the National Assembly in the hall on June 21. On the sidelines of the National Assembly, delegate Truong Xuan Cu (Hanoi delegation) said that the Land Law must specify the Party's policies and guidelines, the State's laws, especially Resolution 18, which has raised urgent issues that need to be focused on solving regarding land prices, land allocation, land management, and land planning.
“However, solving the land problem is also a difficult problem,” he told Nguoi Dua Tin.

Regarding the method of determining land prices, Mr. Cu said that the law cannot address the issue of how to determine land prices. Because land prices always fluctuate. Therefore, he said that it is reasonable to only issue a general regulation that land prices follow the market mechanism.
“I have seen a piece of land in Soc Son and a piece of land in Vinh Phuc sharing the same ditch, but one side follows Hanoi land prices, the other side follows the provincial land prices. One side is 40 million VND, the other side is only about 4 million VND, how to handle it? It cannot be put into law.
Therefore, if we put it into law, it will be determined according to the market mechanism, calculated, and determined professionally to be most reasonable. Avoid the current situation where land price determination is often not accurate, people are at a disadvantage while business owners of commercial houses enjoy too much land rent, which is unreasonable," Mr. Cu analyzed.
Also in the corridor, delegate Tran Hoang Ngan (HCMC delegation) said that over the past 10 years, the Land Law has made certain progress in reducing disputes and making land use more and more effective. However, until today, land has always been a “hot” issue, attracting the attention of many National Assembly delegates and the public.
According to the delegates, during the discussion in the hall on the morning of June 21, there were 3 major contents that the delegates were interested in. First, the recovery work. Second, support and resettlement. Third, compensation.

Therefore, there must be detailed regulations for land acquisition cases. We need to note that even if there is high compensation, it will not be able to replace the settlement of people when people have bought land and chosen a place to live. That is, before buying, people have researched all factors, such as the surrounding environment, family, tradition, hometown, etc.
“Therefore, it is necessary to minimize land reclamation cases. When reclamation of land, there must be a good communication plan, with the participation of elected organizations to supervise from the beginning,” Mr. Ngan said.
In this draft of the Land Law (amended), there are 14 articles in chapter 15 on supervision, inspection, and examination work, which are very detailed, including supervision by citizens or through organizations representing citizens, People's Councils, National Assembly deputies... to strengthen supervision work.
“I think we need to pay more attention to monitoring the land acquisition policy from the beginning. Because if we deal with the consequences after it has been implemented, it will cause a lot of difficulties for the people,” Mr. Ngan said.
Therefore, it is necessary to supervise from the beginning the project implementation plan, by discussing and collecting opinions from the people, the Vietnam Fatherland Front...
In addition, people are also particularly interested in how to calculate land prices to ensure reasonableness and protect the legitimate rights of people. Regarding the method of calculating land prices, there should also be a general agreement on choosing the most reasonable method so that people and other organizations can rely on it to calculate land prices.
According to delegate Tran Hoang Ngan, the public is also very interested in the Land Law, which is the use of public land. This is a burning issue today, so how can we use public land effectively?
Because if public land is left to waste, it can easily lead to frustration. Meanwhile, society is in dire need of financial resources to invest in economic and social infrastructure projects such as transportation, hospitals, schools, flood control, etc., but there are many public land projects that are not being used effectively, including public assets.
Finally, regarding the issue of land-related taxes, delegate Tran Hoang Ngan said that we must pay attention to resolving suspended projects. If they are suspended for a “long term”, land use will be very wasteful, and more importantly, it will affect the environment.
Therefore, it is necessary to use tax and land recovery tools for public projects. Investment projects that are left unimplemented for too many years must be recovered.
If the land is owned by the people but is wasted, use the land tax tool for wasteful land use.
