After the arrangement, the number of specialized agencies of the National Assembly includes the Ethnic Council and 7 Committees.
On the afternoon of February 6, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly and 3 drafts: Resolution of the National Assembly on the organizational structure of the National Assembly's specialized agencies; Resolution of the National Assembly on the number of members of the 15th National Assembly Standing Committee (amended); Resolution of the National Assembly Standing Committee on the specific tasks, powers and organizational structure of the National Assembly's specialized agencies.
At the meeting, Mr. Hoang Thanh Tung, Chairman of the National Assembly's Law Committee, reported on a number of major issues and differences of opinion in the process of drafting the Law on amending and supplementing a number of articles of the Law on the Organization of the National Assembly and the draft Resolutions on the organizational structure, tasks, and specific powers of the National Assembly's specialized agencies.
Specifically, regarding the number, organizational structure and method of regulating the specialized agencies of the National Assembly, Mr. Tung said that the majority of opinions agreed with the drafting of the National Assembly Resolution on the organizational structure of the specialized agencies of the National Assembly. Accordingly, after the arrangement, the number of specialized agencies of the National Assembly includes the Ethnic Council and 7 Committees.
Mr. Tung also said that there were opinions suggesting continuing to clearly stipulate in the Law on Organization of the National Assembly the number and names of the National Assembly Committees to ensure the legal status of the agencies; the phrase "agency of the National Assembly" should be used instead of the phrase "specialized agency of the National Assembly". The drafting committee found that, in the context of the arrangement of the State apparatus and the requirement to innovate legislative thinking, not rigidly stipulating the number and names of the National Assembly agencies in the Law is appropriate and convenient for continuing to implement the arrangement, adjustment, and ensuring harmony in the organizational structure with the functions, tasks, and powers of the agencies; this issue was also approved by the Politburo when giving opinions on draft laws on the organization of the apparatus. The use of the phrase "specialized agency of the National Assembly" is appropriate to the functions and nature of the activities of these agencies.
Regarding the division of tasks and powers of the National Assembly's specialized agencies, according to Mr. Tung, during the discussion, all agencies agreed with the principles and contents of the division of powers of the Council and Committee as in the draft Resolution.
Regarding some specific contents, some agencies have opinions. Accordingly, regarding the field of religion, the Standing Committee of the Ethnic Council proposed to consider assigning the Ethnic Council to be in charge of the field of religion and belief to ensure balance and harmony in tasks and powers among agencies and to concentrate the focal agency. However, the Standing Committee of the Committee for Culture and Education and the Standing Committee of the Social Committee proposed to continue assigning this field to the Committee for Culture and Social Affairs as before the arrangement.
Regarding the examination of international treaties, the Standing Committee of the National Defense and Security Committee proposed that the examination of international treaties should be assigned to the Ethnic Council and the Committees in charge of each field to facilitate implementation. Accordingly, the Committee on National Defense, Security and Foreign Affairs will only examine international treaties within the field of responsibility of the Committee. The Drafting Committee proposed to continue to assign the Committee on National Defense, Security and Foreign Affairs as the focal agency to preside over the examination of international treaties as the Foreign Affairs Committee currently does and other agencies in charge of the field to participate in the examination to facilitate monitoring and supervising the process of participating in negotiations, signing, joining and organizing implementation to ensure consistency in the implementation of the State's foreign policy.
Regarding the examination of reports of a number of agencies, the Draft Resolution of the National Assembly Standing Committee summarizes that the Ethnic Council and the Committees are responsible for examining reports, projects and other proposals in their respective fields or as assigned by the National Assembly and the National Assembly Standing Committee. Through discussion, there are opinions suggesting that some Committees should continue to be responsible for examining specific reports of relevant agencies because these are annual reports, which serve as an important basis for monitoring and evaluating the performance of reporting agencies and proposing policies in relevant draft laws, ordinances and resolutions. However, if specific types of reports are prescribed, they may overlap with the provisions of other laws and resolutions and will be difficult to cover and update promptly when there is a request to change the content and deadline of the report.
Regarding the supervision and guidance of the activities of the People's Council, the Draft Resolution stipulates that the Standing Committee of the Delegation Work Committee continues to advise the National Assembly Standing Committee in performing the supervision and guidance of the activities of the People's Council, which is the task that the Delegation Work Committee is performing.
According to Mr. Tung, there are opinions that the content related to the organization of the State apparatus, including the organization and operation of local governments, is under the responsibility of the Committee on Law and Justice. Therefore, to ensure the unity of only one focal point in charge of the advisory content, assisting the Standing Committee of the National Assembly and in accordance with the scope of the responsible field and practical requirements, it is proposed to assign the Standing Committee of the Committee on Law and Justice to assist the Standing Committee of the National Assembly in performing the task of supervising and guiding the activities of the People's Council; assign the Standing Committee of the Delegation Affairs Committee to continue to assist the Standing Committee of the National Assembly in performing tasks related to personnel work for the People's Council such as approving the election results, dismissing and removing positions of the People's Council, organizing training and fostering for People's Council delegates, organizing conferences to exchange experiences in the activities of the People's Council and the Standing Committee of the People's Council.
Concluding the discussion session, Vice Chairman of the National Assembly Nguyen Khac Dinh said that the draft Law, 3 draft resolutions and accompanying documents are eligible to be submitted to the National Assembly and the National Assembly Standing Committee for consideration and decision.
