Clarifying responsibility for the delay in issuing documents implementing the Land Law
This afternoon (October 8), Deputy Prime Minister Tran Hong Ha chaired a national online conference on the implementation of the Land Law, Housing Law, and Real Estate Business Law.
The Deputy Prime Minister assessed that the above 3 laws are closely related to the implementation of specific tasks and projects serving socio-economic development and ensuring national security and defense. The goal is to remove difficulties, propose a number of new policies and guidelines to create development resources, including the real estate market, and ensure housing policies.
The Government has worked with localities to develop and issue synchronous documents under the authority of 15 decrees and 2 decisions of the Prime Minister, and no circulars have been delayed in issuance.
However, according to the Deputy Prime Minister, as of October 7, no locality has issued all legal documents under its jurisdiction. Some localities have not issued any documents for implementation.

The Government leader requested localities to clarify the causes and responsibilities for the delay in issuing decisions within their authority, the extent of impact on socio-economic development in the area, the mobilization of land resources, the operation of the real estate market, the implementation of housing mechanisms and policies, etc.
The Deputy Prime Minister directed localities to clearly propose difficulties and problems that need to be resolved by the Prime Minister and ministers. Ministries, branches and agencies must take responsibility to join hands in guiding localities to resolve them.
The ultimate goal is to speed up the issuance of documents implementing the three laws to meet the urgent and necessary requirements of life in order to remove difficulties and introduce better policies.
50 localities have not yet issued documents guiding the implementation of the Housing Law.
Regarding the Housing Law and the Real Estate Business Law, Deputy Minister of Construction Nguyen Van Sinh said that the Prime Minister has strongly directed the implementation of these two laws, especially the issuance of detailed regulations.
Recently, the Ministry of Construction has also issued many guiding documents urging ministries, branches and localities to promptly issue detailed regulations and instructions for the implementation of the two laws under their authority.
The Ministry has sent 7 documents to the People's Committees of provinces and cities, the Ministry of Public Security, the Ministry of National Defense, the Ministry of Finance, and the State Bank on the implementation of assigned tasks in the Housing Law and the Law on Real Estate Business.
According to Mr. Sinh, the latest reports from localities show that 13 localities have issued documents detailing the Housing Law. Currently, 50 localities have not issued them. Of these, 10 localities have completed the construction and are submitting them to the Provincial People's Committee for consideration and promulgation, and 40 localities are in the process of construction or are submitting them for appraisal by the Department of Justice.

At the conference, Deputy Minister of Natural Resources and Environment Le Minh Ngan said that the Government and the Prime Minister have issued many documents directing ministries, branches and localities to urgently focus on developing detailed regulations and guidelines for the implementation of the Land Law.
The Ministry of Natural Resources and Environment has issued many documents to proactively urge and guide localities to organize the implementation of the Land Law.
According to Mr. Ngan, up to now, 50/63 provinces and cities have issued some documents detailing the implementation of the Land Law. However, no locality has issued all the legal documents under its authority. Some localities have not issued any documents for implementation.
Of the 50/63 provinces and cities that have issued documents, only Hai Duong province has issued all the contents assigned to be detailed in the law. The remaining localities mainly issue contents related to compensation, resettlement support, regulations on land allocation limits, recognition of land use rights, conditions for land division and consolidation, etc.
There are 13 provinces and cities that have not issued documents, including Cao Bang, Ninh Binh, Quang Nam, Quang Ngai, Gia Lai, Dak Nong, Tien Giang, Can Tho, Bac Lieu, Ca Mau, Phu Yen, Binh Phuoc and An Giang.
The Deputy Minister of Natural Resources and Environment assessed that after 2 months of implementation, with the new regulations of the Land Law, the initial results showed that the new policies have brought about effectiveness such as decentralization, delegation of authority on land use conversion, land recovery, land price determination, issuance of land use right certificates... have created consensus among the majority of people, the business community and unity among agencies from central to local levels.
