On November 9, discussing the Draft Law on Teachers in groups, National Assembly deputies assessed that the Draft mentioned many new points on policies for teachers to develop and elevate, honor the teaching profession, and overcome shortcomings in State management of teachers.

Policy to attract teachers is still general

Participating in the discussion, National Assembly delegate Pham Trong Nghia (National Assembly Delegation of Lang Son province) said that regarding the policy to attract teachers (Clause 1, Article 29 of the Draft Law stipulates that the beneficiaries of the attraction policy include:   Highly qualified people, talented people, excellent graduates, young scientists, and people with special gifts are recruited as teachers; teachers working in particularly difficult areas such as ethnic minority areas, mountainous areas, coastal areas, and islands.

Delegates said that, basically, policies to attract teachers are necessary, however, the content in Article 29 is still general, lacking in breakthroughs to create attractiveness; not convincing enough to attract highly qualified and talented people to work in particularly difficult areas.

"Without specific and clear policies, attracting teachers as the goal and desire of the Draft Law when setting out this regulation will be very difficult to implement," said delegate Pham Trong Nghia.

In addition, the Draft Law has not clarified what is considered a highly qualified person, a talented person, or a person with special gifts. Therefore, delegates proposed to clearly define these subjects to facilitate practical application.

Concerned about the policy of attracting teachers, National Assembly delegate Thai Van Thanh (National Assembly delegation of Nghe An province) proposed adding 2 subjects, which are: high school students with excellent academic performance, winning national and international excellent student awards are admitted directly into the teaching profession; excellent university graduates are retained at the school as lecturers.

"These teams will contribute to improving the quality of education, the quality of human resource training at all levels and the national education system," said delegate Thai Van Thanh.

Regarding the regime and policies for teachers, delegate Thai Van Thanh proposed to clearly identify the resources to implement policies for teachers (such as salaries, allowances, attraction and preferential policies, etc.), including the resources of the Central Government and local resources to ensure the Law is feasible, effective and soon comes into life.

Delegate Luong Van Hung (National Assembly Delegation of Quang Ngai Province) said that the Draft Law does not have regulations on protecting teachers in their professional activities; there is a lack of policies to build a safe working environment to help teachers feel secure in their work, contribute and perform their professional activities effectively. The delegate proposed to add a provision that teachers have the right to organize extra classes according to the provisions of the law.

Clarifying teachers' rights to participate in production and business activities

Participating in the discussion, National Assembly delegate Nguyen Thi Lan (National Assembly Delegation of Hanoi) was interested in the regulations on teachers' rights and requested the drafting agency to review, clarify and unify the regulations at Point d, Clause 1, Article 11 of the Draft Law on Teachers and the regulations at Point b, Clause 2, Article 17 of the 2020 Law on Enterprises.

Specifically, at Point d, Clause 1, Article 11 of the Draft Law stipulates that teachers: “Are allowed to conduct scientific research and transfer scientific research products according to the provisions of law on scientific research and intellectual property; are allowed to participate in activities at production and business establishments suitable for their expertise and profession”. Delegates said that this is a permissible regulation, understood as teachers are given the right to conduct scientific research and transfer scientific research products; at the same time, are allowed to participate in activities at production and business establishments suitable for their expertise and profession.

The delegate pointed out that, according to the provisions of Point b, Clause 2, Article 17 of the 2020 Enterprise Law, cadres, civil servants and public employees as prescribed by the Law on Cadres, Civil Servants and the Law on Public Employees do not have the right to establish and manage enterprises in Vietnam.

"It is necessary to clarify which activities and stages of production and business activities teachers are allowed to participate in at production and business establishments in accordance with their professional expertise? Are teachers allowed to establish or participate in establishing and managing enterprises?" - delegate Nguyen Thi Lan stated.

According to the delegate, if not clarified, it will lead to different understandings of the law, making it difficult to implement in practice, and possibly unintentionally violating the provisions of the law.

What type of contract is a teacher's labor contract ?

Speaking at the discussion, Venerable Thich Bao Nghiem (National Assembly Delegation of Hanoi City) said that at point d, clause 3, article 16 stipulates: "People who have had a labor contract as teachers in educational institutions for 2 years or more" are eligible for special privileges and priority in teacher recruitment".

The delegate said that it is necessary to clarify what type of contract the "labor contract for teachers" is, because the contract for teachers is stipulated in Clause 1, Article 19 of the Draft Law, including: work contract according to the provisions of the law on civil servants and labor contract according to the provisions of the law on labor.

In which, employment contracts are divided into 2 types: fixed-term employment contracts and indefinite-term employment contracts (Clause 2 and Clause 3, Article 19). Labor contracts apply to teachers in non-public educational institutions and teachers who are foreigners (Clause 4, Article 19).

Venerable Thich Bao Nghiem raised the question: "Is the labor contract for teachers in Article 16 the same as the labor contract stipulated in Article 19?" "If so, I think that the policy of giving priority to recruiting teachers for those who have had a labor contract for teachers is not appropriate."

Explaining this, Venerable Thich Bao Nghiem said that the priority subjects are only teachers in non-public educational institutions and teachers who are foreigners; and if the labor contract for teachers in this Draft is a type of labor contract to perform professional and technical work as prescribed in Decree 111/2022/ND-CP of the Government dated December 30, 2022 on contracts for certain types of work in administrative agencies and public service units, it also needs to be clarified.
