Kinhtedothi - On the morning of February 19, continuing the 9th extraordinary session, the 15th National Assembly voted to pass a Resolution regulating the handling of a number of issues related to the reorganization of the State apparatus.
There is a roadmap for arranging the number of deputies at the merged unit.
Before voting to pass, Chairman of the National Assembly's Committee on Law and Justice Hoang Thanh Tung presented a report explaining, accepting and revising the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the State apparatus.
According to Chairman of the Law and Justice Committee Hoang Thanh Tung, there are opinions suggesting not to stipulate the arrangement of the number of deputies in this resolution but to leave it to the Government to stipulate. However, the National Assembly Standing Committee said that the number of deputies of heads of agencies and organizations is currently specifically regulated in many laws, resolutions and sub-law documents.
When reorganizing the state apparatus, especially in the case of merging and consolidating agencies, the number of people holding deputy positions of heads in agencies may be higher than prescribed. Therefore, this resolution needs to have regulations on the number of deputy heads to have a basis for organization and implementation.
The Resolution stipulates that when reorganizing the State apparatus, if the number of deputies of the agency head is greater than the maximum number prescribed by law, then no later than 5 years from the effective date of the decision on reorganizing the apparatus by the competent authority, the number of deputies of the agency head must comply with regulations.
Conduct inspections when reorganizing the apparatus
According to the newly passed resolution, the inspection agency, after the reorganization of the State apparatus, shall continue to perform the inspection functions and tasks of the agency that transferred the inspection functions and tasks. The agency that no longer conducts inspections after the reorganization of the State apparatus shall perform the inspection functions and tasks within the scope of State management according to the provisions of law.
The agency assigned to perform specialized inspection functions after the reorganization of the State apparatus shall not perform specialized inspection functions but shall perform specialized inspection functions and tasks according to the provisions of law.
The Resolution also clearly states that, for ministries and ministerial-level agencies that no longer organize inspections after the reorganization of the State apparatus, in case of necessity, the Minister or Head of the ministerial-level agency shall establish an inspection team or request the Government Inspectorate to conduct inspections.
In particular, the inspection agencies of the Ministry of National Defense, the Ministry of Public Security, the State Bank of Vietnam and inspection agencies established under international treaties to which the Socialist Republic of Vietnam is a member shall continue to perform inspection functions and tasks in accordance with the provisions of law.
In case the inspection is in progress or has finished the direct inspection but the inspection conclusion has not been issued, the inspection team shall continue to perform its duties, develop a draft inspection conclusion and submit it to the Head of the competent inspection agency after arranging the State apparatus for consideration and issuance of the inspection conclusion.
In addition, if an agency, after restructuring the State apparatus, no longer organizes inspections, the head shall assign a subordinate unit to perform the functions and tasks of receiving citizens, resolving complaints and denunciations, and preventing and combating corruption, waste, and negativity according to the provisions of law.
With 456/459 delegates in favor, the National Assembly passed a resolution regulating the handling of a number of issues related to the reorganization of the state apparatus.
This Resolution comes into force from the date of its approval by the National Assembly.
The Resolution stipulates the handling of a number of issues related to the reorganization of the State apparatus, including 15 articles; stipulates the handling of a number of issues related to the reorganization of the State apparatus, including: handling principles; changing the names of competent agencies, organizations, units, and positions; the performance of functions, tasks, and powers of competent agencies and positions according to the provisions of law, international treaties, international agreements, and the handling of a number of other issues when implementing the reorganization.
This Resolution is applied to the reorganization of the State apparatus in cases of establishment and reorganization (including the reorganization and consolidation of agencies in the form of division, separation, merger, consolidation, conversion or adjustment of functions, tasks and powers), change of name, change of model, organizational structure, and dissolution of agencies to implement the Party's policy on continuing to innovate and reorganize the apparatus of the political system to be streamlined and operate effectively and efficiently.
