When are traffic police allowed to stop vehicles to check documents?

During the patrol, control and handling of violations, pursuant to the provisions of Article 16, Circular No. 65/2020/TT-BCA dated June 19, 2020. Currently, there are 4 cases where the Traffic Police are allowed to stop vehicles participating in traffic to check documents:

Case 1: Traffic police directly detect, or through professional technical equipment detect and record violations of road traffic laws and other violations of law, they are allowed to stop the vehicle for inspection.

Case 2: Stopping vehicles for inspection is carried out according to orders and plans for general control of road vehicles, patrolling, controlling, and handling violations according to the subject approved by competent authorities.

Case 3: According to the written request of the head or deputy head of the investigation agency or of the relevant competent authority to control and serve the work of ensuring security, order, and fighting against crime.

Case 4: When there is a report, reflection, recommendation or denunciation from an organization or individual about illegal acts of people and vehicles participating in traffic.

Stop vehicle inspection in emergency lane

Traffic police are allowed to stop and check vehicles in the emergency lane when patrolling or conducting mobile control in the following cases:

- Detect serious traffic safety and order violations and immediate traffic safety risks.

- Coordinate the fight against crime.

- When there is a report or denunciation of a crime committed by a person or vehicle traveling on the highway.

- Detecting illegal stopping and parking on the highway.

- Stop the vehicle to collect the markers, tension ropes, warning signs and move immediately.

Traffic police principles when stopping to check vehicle documents

When stopping a vehicle for inspection, the following principles must be followed:

- Ensure safety in accordance with legal regulations and do not obstruct traffic.

- Place markers and ropes to ensure traffic safety and order.

- Ensure sufficient space to install equipment and professional techniques.

- Arrange traffic police to guide and regulate traffic, ensuring traffic safety.

- In case of control on the highway, there must be a slow-down sign.
