Hundreds of plots of land recovered for settlement project
According to the documents obtained by Nguoi Dua Tin , on January 27, 2004, the Chairman of Binh Duong Provincial People's Committee issued Decision No. 657/QD-CT on the recovery of 1,892,525m2 of land, including 342 plots currently managed and used by households, individuals and organizations, and public land in Binh Hoa commune, Thuan Giao commune, An Phu commune (Thuan An district, Binh Duong province) to be transferred to the Trade - Investment and Development Company (Becamex Corp) for compensation, in order to implement the Viet Sing Settlement Area project. The decision also clearly stated that Becamex Corp would be assigned to manage the entire area of recovered land to organize an inventory and verify the origin of the land as a basis for compensation for land and assets on the land for those whose land is recovered.
The list attached to this decision includes the names of Bo Thi Thu (list number is 82, file number is 94 with a recovered area of 9,718m2 and a compensated area of 9,718m2; land located at Hamlet 04, An Phu Commune, Thuan An District, Binh Duong Province - now An Phu Ward, Thuan An City, Binh Duong Province) and Vo Kim Lien (list number is 58, file number is 76 with a recovered area of 8,239m2 and a compensated area of 8,239m2; land located at Hamlet 04, An Phu Commune, Thuan An District, Binh Duong Province - now An Phu Ward, Thuan An City, Binh Duong Province).
On April 2, 2004, the People's Committee of Binh Duong province issued Decision No. 2926/QD-CT to revoke 66 land use right certificates, allocate land and grant land use right certificate No. 81/QSDD/2004 to Becamex Corp. In which, the land use right certificate of Ms. Bo Thi Thu (this land plot was granted a land use right certificate by the People's Committee of Thuan An district on December 8, 1998 to Ms. Bo Thi Thu's household) and Ms. Vo Kim Lien (this land plot was granted a land use right certificate by the People's Committee of Thuan An district on August 6, 1998, to Ms. Vo Kim Lien's household) was revoked.
Ms. Bo Thi Kim Anh and Bo Thi Kim Loan point to their family's land area that was confiscated to implement the Viet Sing Settlement Area project.
In 2008, Mrs. Bo Thi Thu passed away, her children Bo Thi Kim Loan and Bo Thi Kim Anh inherited the will and took charge of managing the land area left by their mother. Also during this period, Mrs. Bo Thi Kim Loan, Bo Thi Kim Anh and Mrs. Vo Kim Lien heard information from some residents about the decision of the Binh Duong Provincial People's Committee to reclaim land from hundreds of households to hand over to Becamex Corp to implement the Viet Sing resettlement area project.
Sharing with reporters, Ms. Bo Thi Kim Loan said: “My family does not know exactly whether our land area will be recovered or not because during the land recovery process, Becamex Corp did not use our family's land area to build the Viet Sing Settlement Area. Until now, my family's land area is still empty, with no project being implemented.” Regarding this opinion, Ms. Vo Kim Lien also shared the same opinion.
During the process of completing procedures to re-issue the Land Use Right Certificate for the land of the above-mentioned household, Ms. Bo Thi Kim Loan, Bo Thi Kim Anh and Vo Kim Lien were just notified in writing by the authorities of Thuan An district and the Department of Natural Resources and Environment of Binh Duong province that the land plot in the name of Ms. Bo Thi Thu and Ms. Vo Kim Lien's household had been revoked by the People's Committee of Binh Duong province and the land use right certificate in the name of Ms. Bo Thi Thu and Vo Kim Lien had also been revoked.
Signs of forged documents?
According to Ms. Loan and Ms. Lien, this was the first time they had known about these land reclamation decisions. The authorities did not provide them with copies of these decisions, but through social relationships, the two women were able to obtain photocopies of the decisions. After reviewing the decisions, they learned that their households had the right to compensation when the State reclaimed their land, as stated in the above decisions. Notably, from 2004 to the present, Ms. Bo Thi Thu (at the time of her death), Bo Thi Kim Loan, Bo Thi Kim Anh and Ms. Vo Kim Lien have not received any documents, materials or benefits from the authorities of Binh Duong province and Becamex Corp as prescribed.
According to the women, they have never participated in meetings or signed documents related to land recovery records and compensation records for site clearance for their family's land plot. The land recovery decisions of Binh Duong Provincial People's Committee for Mrs. Bo Thi Thu's household and Mrs. Vo Kim Lien's household. The decision on the revocation of land use right certificates of Binh Duong Provincial People's Committee for land use right certificates in the name of Bo Thi Thu's household and Mrs. Vo Kim Lien's household. They have also not received any benefits (land compensation for resettlement...) related to the recovery of their family's land according to the provisions of the land law.

More surprisingly, the women were later informed by the Department of Natural Resources and Environment of Binh Duong province and provided with a copy of the "Land Use Rights Transfer Contract" between Ms. Bo Thi Thu and Mr. Bui Quang Chien, made on December 2, 2002. Accordingly, Ms. Bo Thi Thu sold all of her land to Mr. Bui Quang Chien. This contract was confirmed by the People's Committee of An Phu commune. Meanwhile, Ms. Vo Kim Lien was also provided with a copy of the "Land Use Rights Transfer Contract" between Ms. Vo Kim Lien and Mr. Nguyen Van Hoang. This contract was made on July 1, 2002, according to which Ms. Vo Kim Lien sold all of her land to Mr. Nguyen Van Hoang. This contract was also confirmed by the People's Committee of An Phu commune.
Ms. Bo Thi Kim Loan and Ms. Vo Kim Lien affirmed that they did not know about or sign this contract and this was the first time they knew about this. The signatures and fingerprints in these "Contracts" are not theirs and there are signs of forged signatures?
According to Ms. Bo Thi Kim Loan and Vo Kim Lien, these "Contracts for Transfer of Land Use Rights" do not have legal value as a basis for determining the legal rights of Mr. Bui Quang Chien and Nguyen Van Hoang to use the transferred land plots according to the above Contracts. This is further confirmed and confirmed by the fact that on January 27, 2004, the People's Committee of Binh Duong province issued Decision No. 658/QD-CT on the recovery of land managed and used by households and individuals, transferring it to Becamex Corp for compensation in the Viet Sing resettlement area project and adjusting it in Decision No. 1624/QD-CT dated April 18, 2005. The reason is that these Decisions still show the names of the land users whose land was recovered and who were compensated when the land was recovered by the State, namely Ms. Bo Thi Thu and Ms. Vo Kim Lien - the legal names on the land use right certificates.
Therefore, the fact that Ms. Bo Thi Kim Loan and Ms. Bo Thi Kim Anh, members of Ms. Bo Thi Thu's household and legal heirs of Ms. Bo Thi Thu and Ms. Vo Kim Lien, are not entitled to receive any benefits from the above land recovery decisions, further shows the irregularity in the case.
In response to this incident, Ms. Bo Thi Kim Loan, Ms. Bo Thi Kim Anh and Ms. Vo Kim Lien filed a complaint, claiming that the act of forging the "Contracts for Transfer" of land use rights, forging signatures and fingerprints of them and their family members. The purpose of the crime was to appropriate the rights and benefits compensated by the state when the state reclaimed the land.
Regarding the case, on August 17, 2023, the Ministry of Public Security issued an official dispatch assigning the Inspectorate of the Ministry of Public Security to verify and handle the case of Ms. Bo Thi Kim Anh. After verification, based on the provisions of the law, the Inspectorate of the Ministry of Public Security requested the Head of the Investigation Police Agency of Thuan An City Police, Binh Duong Province to consider and resolve. At the same time, on October 5, 2023, the Office of the Investigation Police Agency of Binh Duong Province Police also issued an official dispatch requesting the Head of the Investigation Police Agency of Thuan An City Police to consider and resolve the cases of Ms. Bo Thi Kim Loan, Bo Thi Kim Anh, and Vo Kim Lien.
Quang Minh Law Office Hanoi (Hanoi Bar Association) - the law office protecting the rights and interests of Ms. Bo Thi Kim Loan, Ms. Bo Thi Kim Anh and Ms. Vo Kim Lien as well as their authorized representative, Mr. Trinh Huu Hoa, also sent a petition to the People's Committee of Binh Duong province requesting and requesting the provision of documents related to land recovery and compensation for the women when the state recovers the land. The People's Committee of Binh Duong province responded in writing, requesting the Department of Natural Resources and Environment of Binh Duong province to respond, but up to now, it has been silent for many months.
