Commune chairman removed from office for allowing restaurant to 'grow' on agricultural land

On June 11, Mr. Nguyen Van Vien, Vice Chairman of the People's Committee of Thuy Nguyen District (Hai Phong City), said that the district had just removed Mr. Nguyen Van Len from his position as Chairman of the People's Committee of Quang Thanh Commune for violating land management regulations, allowing people to encroach on 766 ^square meters of public land on the bank of the Hon Ngoc freshwater canal to illegally build a solid restaurant.

In addition to Mr. Len, the Vice Chairman of the Commune People's Committee and the cadastral officer of Quang Thanh Commune were also disciplined by Thuy Nguyen District with a warning.

According to the People's Committee of Thuy Nguyen District, the violating construction belongs to Mr. Nguyen Dang Cong (41 years old, in Phu Ninh Commune, Thuy Nguyen District) in Village 1, Quang Thanh Commune, with a scale of 2.5 floors and an area of 517 ^m2 . Regarding the origin, the violating construction is agricultural land for growing other annual crops managed by the People's Committee of Quang Thanh Commune.

Previously, in June 2022, Mr. Cong's family accepted the transfer of a residential land plot with a red book, area of 419 ^m2 , on road 352 in village 1, Quang Thanh commune from a household. After that, he built the Bamboo restaurant. Instead of building a restaurant on the land with a red book, Mr. Cong built on another 766 ^m2 of agricultural land managed by the People's Committee of Quang Thanh commune, adjacent to the residential land plot, close to Hon Ngoc canal.

Mr. Cong's illegal restaurant construction took place in July 2022, but it was not until April 28, 2023 that the People's Committee of Quang Thanh Commune issued an administrative violation record No. 01/BB-VPHC. At that time, the project was completed and ready to be put into operation.

On May 11, the People's Committee of Thuy Nguyen District issued a decision to administratively fine Mr. Cong with a total fine of 7.7 million VND; at the same time, assigned the Department of Natural Resources and Environment, Justice, Inspectorate and Quang Thanh Commune to mobilize and persuade the owner of the construction to voluntarily dismantle the restaurant. However, Mr. Cong did not comply and even submitted a petition to the authorities with the content that the 766 ^m2 of land on which he built the restaurant was not encroached land. It was garden land that Mr. Cong bought and sold in the form of a handwritten paper with a household.

To strictly maintain legal discipline in state management of land, on May 25, the People's Committee of Thuy Nguyen District issued Decision No. 4501/QD-CCXP on compulsory implementation of remedial measures, restoring the original state of the land plot before the violation.

It is known that on June 13, Thuy Nguyen District will carry out enforcement against the Bamboo restaurant project of Mr. Nguyen Dang Cong.
