Ministry of Health requires inspection and supervision of prescriptions and indications in medical examination

The Ministry of Health has just issued a document on strengthening the inspection and supervision of prescriptions and indications in medical examination and treatment for patients sent to hospitals under the Ministry of Health and universities; Departments of Health of provinces and cities; and health care of ministries and branches.

Accordingly, the document clearly states that the Law on Medical Examination and Treatment No. 15/2023/QH15 dated January 9, 2023 takes effect from January 1, 2024.

Medical examination and treatment facilities nationwide need to research, implement and comply with the provisions of the Law on Medical Examination and Treatment;

Decree No. 96 dated December 30, 2023 of the Government detailing a number of articles of the Law on Medical Examination and Treatment and guiding circulars of the Ministry of Health. These documents clearly stipulate the prescription of drugs and the indication of the implementation of technical services and medical equipment.

In order to ensure the rights of patients, put patients at the center, and ensure the quality of medical examination and treatment, the Ministry of Health requires the Heads of the above units to disseminate and strictly implement the provisions of the Law on Medical Examination and Treatment and related documents, including important provisions such as:

The Ministry of Health recommends strengthening inspection and supervision of compliance with drug prescription regulations.

In Article 7. Prohibited acts in medical examination and treatment activities: Clause 7. Prescribing and indicating the use of drugs that have not been licensed for circulation according to the provisions of the law on pharmaceuticals in medical examination and treatment;

Article 9. Prescribing drugs, ordering technical services and medical equipment, suggesting transferring patients to other medical examination and treatment facilities or engaging in other acts for profit.

Article 63. Use of drugs in treatment: Point a, Clause 1. Prescribe drugs when absolutely necessary, for the right purpose, safely, reasonably and effectively; Point b, Clause 1. Prescription of drugs must be consistent with the diagnosis and condition of the patient;

The Ministry of Health requests the above units to direct, strengthen inspection and supervision of compliance with regulations on drug prescription, indication of technical services and medical equipment at medical examination and treatment facilities.

At the same time, continue to implement the previous document No. 1696 of the Department of Medical Examination and Treatment Management on enhancing the safe, rational and effective use of drugs at medical examination and treatment facilities.

Review, detect, correct and promptly handle negative behaviors in prescribing drugs, assigning medical techniques and services to get "commissions", causing trouble for patients in order to profit from patients as well as the Health Insurance Fund .
