Ministry of Construction synthesizes opinions to complete draft Decree on renovation and reconstruction of apartment buildings

On March 28, 2024, in Hanoi, Deputy Minister Nguyen Van Sinh - Head of the Drafting Committee for the development of Decrees detailing and guiding the implementation of the Housing Law and the Real Estate Business Law chaired a conference to summarize opinions to complete the draft Decree on renovation and reconstruction of apartment buildings. Attending the conference were Vice Chairman of Hanoi People's Committee Duong Duc Tuan, leaders of departments, branches, People's Committees of some districts in Hanoi; leaders of the Department of Construction of some localities in the Northern region, representatives of enterprises operating in the field of housing investment and construction.

This conference took place following the meeting of the Drafting Committee and Editorial Board of the Decrees detailing and guiding the implementation of the Housing Law and the Law on Real Estate Business (early March 2024) and the workshops to receive comments on the completion of the draft Decrees detailing and guiding the implementation of the Housing Law and the Law on Real Estate Business (mid-March 2024 in both Hanoi and Ho Chi Minh City), aiming to complete the draft Decree on renovation and reconstruction of apartment buildings.

At the conference, Deputy Director of the Department of Housing and Real Estate Market Management Nguyen Manh Khoi briefly presented the basic contents of renovation and reconstruction of apartment buildings as stipulated in the Housing Law and the draft Decree on renovation and reconstruction of apartment buildings so that delegates could better understand the new regulations and policies related to this field.

Representatives of the Hanoi People's Committee, departments, branches, People's Committees of some districts of Hanoi and authorities of provinces and centrally-run cities, and enterprises continued to discuss and contribute ideas to help the Drafting Committee and Editorial Team complete the content of the Decree, especially the contents related to the calculation of compensation coefficients (coefficient K), handling of interlaced land and public assets; planning indicators in the renovation and reconstruction of apartment buildings; there should be regulations on investment phases.

In addition, delegates also commented that the draft Decree needs to clarify regulations related to the organization of apartment building conferences; resettlement arrangements; need to pay attention to investigating and surveying the current status of apartment buildings; detailed regulations on enforcement; consider adding regulations on the roadmap for building apartment building projects; need to pay attention to and assess the capacity of investors in apartment building renovation and reconstruction projects.

According to Vice Chairman of Hanoi People's Committee Duong Duc Tuan, the editorial team needs to consider adding to the draft Decree regulations on assessing the current state of technical infrastructure when inspecting old apartment buildings and clearly stipulate solutions for old apartment buildings with interspersed land, state-owned land, and public assets.

Vice Chairman Duong Duc Tuan suggested that the draft Decree consider the order of priority in renovating and rebuilding apartment buildings because in Hanoi, old apartment buildings are all located in historical inner-city areas or inner-city areas. With the viewpoint of taking people as the root, when renovating and rebuilding apartment buildings, the City government is very interested in determining the coefficient K, in the direction of priority for benefiting people, businesses, and the state.

Concluding the conference, Deputy Minister Nguyen Van Sinh acknowledged and highly appreciated the quality, open and practical contributions of the leaders of the Hanoi People's Committee, localities, businesses as well as experts attending the conference.

The Deputy Minister said that the Drafting Committee and Editorial Team will study, be receptive, and selectively absorb the comments at the conference to further perfect the Decree on renovation and reconstruction of apartment buildings, while emphasizing that the policy on renovation and reconstruction of apartment buildings will be closely linked to urban development and beautification.

According to the Ministry of Construction, following the conference in Hanoi, the Ministry will organize a conference in Ho Chi Minh City with similar content to receive opinions from the Ho Chi Minh City government and southern provinces, and continue to perfect the draft Decree on renovation and reconstruction of apartment buildings.
