Ministry of Information and Communications coordinates to prevent the sale of electronic invoices online

The General Department of Taxation, Ministry of Finance recently issued a document requesting the Ministry of Information and Communications to coordinate in preventing and handling information about selling electronic invoices on cyberspace. According to this agency, recently, there has been a phenomenon of some businesses, organizations and individuals deliberately taking advantage of social network space, using technology to post information, advertise illegal buying and selling of value-added invoices, causing great damage to the state budget.

The General Department of Taxation affirms that the act of posting information and advertising illegal buying and selling of invoices violates the provisions of the 2019 Tax Administration Law and Decree 123 of 2020 regulating invoices and documents.

Therefore, the General Department of Taxation requests the Ministry of Information and Communications to coordinate with the Department of Radio, Television and Electronic Information and relevant units to coordinate with tax authorities to prevent, remove and handle websites with signs of information and advertising the buying and selling of invoices on cyberspace.

At the press conference of the Ministry of Information and Communications held on May 5, answering the press about this issue, Mr. Le Quang Tu Do, Director of the Department of Radio, Television and Electronic Information, Ministry of Information and Communications said that the Department had received a request from the General Department of Taxation.

Emphasizing the view that whichever ministry, sector or locality manages something in the real world will manage that field in cyberspace, Mr. Le Quang Tu Do said that the main role in preventing the buying and selling of electronic invoices online still belongs to the competent authority in charge of this field, the General Department of Taxation (Ministry of Finance).

The coordinating role of the Ministry of Information and Communications is demonstrated in that when the General Department of Taxation and the Ministry of Finance send links to content, accounts, and websites related to illegal invoice trading activities and whose identities cannot be identified, the Ministry of Information and Communications will request domestic and foreign social networking platforms to block and remove them.

“In case the identity is determined, the authorities must handle the violators according to current legal regulations. In case we cannot detect them, we will use measures to remove and prevent them,” said Mr. Le Quang Tu Do.

According to the representative of the Department of Radio, Television and Electronic Information, the above coordination method has been applied by the Ministry of Information and Communications in many fields in the past time. For example, in the management of drugs and functional foods, the Ministry of Health and the Ministry of Information and Communications have agreed that the Ministry of Health will identify drugs and functional foods that are advertised in violation on the internet and whose identities cannot be identified for punishment, and then transfer them to the Ministry of Information and Communications to prevent and remove them.

“The measure of blocking and removing content is not the optimal solution and does not completely handle violations. The important thing is to deal with the root of the problem, that is, strictly handle violators, only then will it have a deterrent and warning effect,” analyzed a representative of the Department of Radio, Television and Electronic Information.

Expanding the issue, the Director of the Department of Radio, Television and Electronic Information informed that the Ministry of Information and Communications has advised the Prime Minister to develop a Directive on ministries, branches and localities to strengthen their management of their fields in cyberspace. This Directive has reached the final stages of the development process, has collected comments from ministries and branches; has completed the comments and is currently being finalized to submit to the Prime Minister for consideration and promulgation.

The representative of the Department of Radio, Television and Electronic Information also stated: “Our lives are shifting to cyberspace. Most of the management areas of ministries and branches have appeared in cyberspace. Therefore, the activities under the management of any ministry, branch or locality in the real world are also under the management functions, tasks and responsibilities of that ministry or locality in cyberspace.”
