On December 17, the Ministry of Transport responded after the press reported on the regulations on emission inspection of motorbikes and mopeds (collectively referred to as motorbikes) from January 1, 2025 according to Circular No. 47 dated November 15, 2024 of the Minister of Transport.
According to the Ministry of Transport, Clause 2, Article 42 of the Law on Road Traffic Order and Safety (Law on Road Traffic Order and Safety) stipulates: Motorcycles are only subject to emission inspection. Emission inspection is carried out in accordance with the provisions of the law on environmental protection and is carried out at emission inspection facilities that meet national technical standards.
Clause 1, Article 65 of the Law on Environmental Protection 2020 (Law on Environmental Protection) stipulates: "Means of transport must be inspected and certified by the inspection agency to meet environmental technical standards according to the provisions of law and international treaties to which the Socialist Republic of Vietnam is a member".
Will follow the implementation roadmap decided by the Prime Minister.
At Point b, Clause 2, Article 102, the Law on Environmental Protection 2020 also assigned the Ministry of Natural Resources and Environment to preside over and coordinate with the Ministry of Transport to submit to the Prime Minister a roadmap for applying national technical standards and regulations on emissions of road motor vehicles circulating in Vietnam.
Thus, the control of road motor vehicle emissions in general and of motorbikes in particular is implemented in accordance with the Law on Environmental Protection and the Law on Road Traffic Safety.
However, the Ministry of Transport affirmed that the time for inspection and application of emission standards for motorbikes will be implemented according to the Prime Minister's Decision, similar to the previous control of automobile emissions, and not mandatory implementation immediately following the effective date of the Law on Road Traffic Safety (January 1, 2025).
The Ministry of Transport said it will closely coordinate with the Ministry of Natural Resources and Environment in developing and completing a roadmap for applying motorcycle emission testing to submit to the Prime Minister for promulgation, on the principle of ensuring consistency with reality, minimizing disruption and impact on people's vehicle usage needs while still ensuring environmental goals.
Along with that, the Government report to the National Assembly to add the price of emission inspection services to the list of inspection service prices so that the Ministry of Transport has a basis to issue economic-technical norms and issue prices for motorbike emission inspection services according to the provisions of law on prices.
Motorcycle maintenance and repair facilities can test emissions
Regarding facilities for motorbike emission testing, in addition to being equipped with emission testing equipment and computers with internet connection, the minimum area required for the emission testing area is 15 m2/1 device and can be used in conjunction with vehicle maintenance and repair activities.
Therefore, in addition to using existing motor vehicle inspection facilities to conduct motorcycle emission inspection, the Department of Science, Technology and Environment and the Vietnam Register have carefully reviewed the experience of some countries in the region, and coordinated with the Vietnam Association of Motorcycle Manufacturers and Importers (VAMM) to propose using motorcycle and motorbike warranty and maintenance facilities of VAMM dealers and socialized facilities to participate in motorcycle emission inspection.
According to the Ministry of Transport, up to now, there are nearly 3,000 facilities nationwide that ensure the implementation of motorcycle emission inspection and minimize the possibility of congestion at emission inspection facilities. This will help keep the price of emission inspection services as low as possible, helping people not to have to spend a lot of money on vehicle emission inspection.
The Ministry of Transport said that when participating with specialized agencies under the Ministry of Natural Resources and Environment to develop and submit to the Prime Minister for promulgation a roadmap for applying emission standards for motorbikes in circulation, the Department of Science, Technology and Environment and the Vietnam Register will conduct research and propose recommendations on the time to apply emission standards to have time to prepare and adapt to serve people and businesses.
The emission inspection cycle is specifically performed as follows:
- During the first 5 years from the year of vehicle manufacture, vehicle owners do not have to submit emission inspection documents and do not have to bring the vehicle to the inspection facility for emission inspection;
- From 5 to 12 years, the emission inspection cycle is 24 months/1 time;
- Over 12 years, the emission inspection period is once every 12 months.
